SUBJECT: NRC INSPECTION REPORT 50155/97012(DRS)

Dear Mr. Powers:

On October 7,1997, the NRC completed an inspection of activitics at your Big Rock Point

, Nuclear Plant. The activity inspected consisted of a review of your investigation report (dated

July 17,1997) pertaining to your Fitness For Duty (FFD) Program. The enclosed report

I

presents the results of our inspection.

Based on the results of this inspection, the NRC has determined that a violation of NRC

requirements occurred in reference to notification of Individuals selected for FFD testing. This

non repetitive, licensee-Identified and corrected violation is being treated as a Non Cited

Violation, consistent with Section Vll.B.1 of the NRC Enforcement Policy. An Inspection

Followup Item was identified in reference to monitoring implementation of some FFD program

enhancements identified in your July 17,1997 letter. The investigation of the specific FFD

related issues identified to you was thorough and the conclusions were supported by the

investigation findings. The scope and depth of the investigation was excellent and identified

some areas for program enhancement that went beyond our scope of questions,

in accordance with 10 CFR 2.790 of the NRC's * rules of Practice,' a copy of this letter and its

enclosure will be placed in the NRC Public Document Room (PDR).
