ORDER The Licensing Board's May 30, 1986 memorandum is wholly unresponsive to our order entered earlier on that date. In referring in that order to "the preservation of all stenographic notes and any other memorials" of everything that was said during the course of the March 25-26, 1986 prehearing conference, we obviously had in mind the notes and any other memorials (e.g., tapes) of the official stenographic reporter.I Thus, the order called upon the Licensing Board to obtain the assurance of the reporter that I

It would, of course, have been entirely inappropriate for us to exercise dominion over any notes or other materials prepared by the Licensing Board members for their personal or internal use.

2 all such materials in his or her possession had been retained and would continue to be retained pendente lite.

Now that it understands the import of the May 30 order, 1

the Licensing Board is to comply with it without further delay. The reporter shall be contacted forthwith and asked to provide the foregoing assurance. In the event that the reporter advises that a portion of the stenographic notes or other memorials has been destroyed, the Board is to ascertain when and why such destruction occurred.

By close of business on June 4, 1986, the Licensing Board shall certify that it has contacted the reporter. If such be the case, the certification shall include the statement that the reporter has provided the requested assurance. If that assurance has not been provided, the Board shall set forth the reasons.

It is so ORDERED. .
