Dear Mr. Davis:

I am responding to your letter of December 14,1997, to the Chairman of the U.S. Nuclear Regulatory Commission (NRC), in which you requested a listing of issues on Millstone Unit 3, and the status of Seabrook, Unit 1.

NRC Inspection Manual Chapter (MC) 0350, " Staff Guidelines for 9estart Approval,"

establishes the guidelines for approving the restart of a nuclear power plant after a shutdown resulung from a significant event, complex hardware problem, or one for which serious management deficiencies have been identified. The NRC staff is applying the guidelines of MC 0350 to the restart approvals of Millstone Units 1,2, and 3 because of NRC concerns regarding the overall effectiveness of the licensee's management. MC 0350 states that the staff should develop a plant-spec.ific restart assessment plan for NRC oversight of each plant startup. The restart assessment plan is to include all expected NRC actions required to be taken before the NRC approvew a plant for restart.

The staff has developed a Restart Assessment Plan (RAP) for each of the Millstone units to incorporate the appropriate aspects of MC 0350 and to address site-specific and unit specific issues. The RAP consists of several major elements that require resolution before plant restart and are related to the root causes for the decline in licensee performance and must be completed prior to restart. A copy of the most recent RAP is enclosed.

With regard to Seabrook station, the plant has had good operational performance marked by 463 days of continuous operation prior to the most recent refueling outage, and more than 100 days of continuous operation following the outage. The plant was shut down on December 5, 1937, to repair a piping leak on the "B" train of the residual heat removal (RHR) system inside containment. Repairs to the RHR piping have been completed While shut down, the licensee has elected to undertake modifications to improve the reliability of the control room air conditioning system. The licensee cxpects to restart the facility in mid-January.
