- 1. Program Description. Please emphasize its creative and novel elements. What is the innovatleef (400 words) e The Nuclear Waste Policy Act of 1982 as amended in 1987 established a national program for the disposal in a geologic repository of high-level radioactive waste (HLW) and spent nuclear fuel from commercial nuclear power plants. The U.S. Department of Energy (DOE) was given responsibility for siting, constmeting, and operating the geologic repository. The U.S. Nuclear j
Regulatory Commission (NRC) was given oversight responsibility consisting primarily of l
developing re;;ulations, conducting prelicensing consultations with DOE at the stafflevel, and eventually licensing a geologic repository to protect public health and safety and the environment. DOE was directed to investigate the Yucca Mountain site in Nevada as a possible site for the geologic repository.
This national program is unique--it has unprecedented regulatory, technical, and political challenges. The NRC staff has had to develop the regulatory framework and technical tools necessary for determining that disposal of 70,000 metric tons or more of spent nuclear fuel and i
high level radioactive wastes can be done without imposing undue risk to public health and safety. In the regulatory framework niena, the staff has led NRC's effort to transition away from i
historical deterministic approaches to licensing critical nuclear facilities, to a risk informed approach % licensing which provides decision makers with the full range of uncertainty associated with any compliance determination. In the technical arena, resource and schedule e
constraints have required a streamlined staff effort to develop the computational tools necessary to determine whether a repository system, a complex non linear system with engineered and natural barriers, meets a prescribed risk standard over an extended time frame of compliance i
(10,000 years or greater). In addition, many of the specific technical issues at Yucca mountain present unique uncertainties that must be resolved with state-of the-art approaches such as -
modeling fluid movement through fractured rock in the unsaturated zone under the thermal load of the waste emplaced in the repository.
As noted above, to meet its responsibilities during the current prelicensing phase and implement

Focusing and prioritizing has improved NRCs attention to safety, while greater efficiency has contributed to operating under reduced budgets and reducing costs for a national program that spends over $350 million each year.
NRCs approach has improved integration of the diverse disciplines making up the NRC team of staff and contractois resulting in more effective and efficient technical work.
' I NRCs early foodback to DOE at the staff level has provided regulatory guidance for resolving

many issues, and provides a regulatory basis for more efficient planning before DOE makes t
substantial investments in additional testing and analyses.
A risk. informed regulatory program focusing on safety will improve the decision-making process by helping to ensure that important issues are not overlooked, that the fbil significance of important issues are evaluated, and that insignificant issues are not exaggerated.
Early feedback to DOE and resolving issues at the stafflevel during prelicensing could i
streamline licensing by reducing the issues that might be raised in the licensing review and hearing process, t
it is expected that NRC's approach will contribute to improving public understanding and confidence in the decision making process for ensuring safety and the primary agencies-DOE and NRC-contributing to the process.
Ultimately, a solution to the high level waste disposal problem is the key to resolving other high priority national issues such as the future of nuclear power generation and cleanup of DOE's

Some obstacles that others might would likely be similar to the challenges we have addressed in our program such as those issues considered most important to safety, developing appropriate analytical to integrating a large staff with diverse technical backgrounds.

Complete funding for NRC's HLW repository program is from Congressional appropriations from the Nuclear Waste Fund established by the Nuclear Waste Policy Act. NRC, requested a budget of $17 million for FY 1998 and received an appropriation of $15 million. the DOE program that we regulate has an annual budget of about $350 million, and to date, the national program has spent over $6 billion.
