Dear Mr Rettinger,

As we discussed in our 6/9/97 presentation to yot, attached is a permit application for a proposed low flow crossing of the Rock Run Creek located on PECO Energy Co property at PBAPS in Peach Bottom Township, York County. We are requesting a Pennsylvania Department of Environmental-Protection Chapter 105 Water Obstruction and Encroachment Permit for encroachments to regulated " Waters of the Commonwealth" necessary for the construction of the O structure. The project will also require U.S. Army Corps of Engineers' Section 404 regulatory approval under the Corps' Pennsylvania State programmatic General Permit (SPGP.1). In the attached application, we desenbe the proposed low flow crossing. Because the design is still conceptual in nature, it is possible that details of the crossing may be refined, it is our intent that this permit apphcation present a design which would be bounding from a DEP review standpointi Therefore, any design changes which may be required would be environmentally more conservative or of no environmental consequence (e g. Smaller width of crossing, subsurface structural design changes, etc). These minor changes would be assured to not affect the conclusions of the hydrology / hydraulic study and not incicase the overall area disturbed by construction, it is requested that your approval of this application allow for such concervative or non-consequential design tefinements.
