APPENDIX A NOTICE OF VIOLATION Oregon State University Agreement State License Corvallis, Oregon 97331 No. ORE-0005-3 General License pursuant to 10 CFR 150.20 As a result of a telephone discussion with the Radiation Safety Officer on May 14, 1986, and in accordance with the NRC Enforcement Policy, 10 CFR Part 2, Appendix C, the following violation was identified:

10 CFR 150.20(b)(1) states, in part, that the Agreement State licensee shall at least 3 days before engaging in each general licensed activity, file 4 copies of Form NRC-241 and 4 copies of the Agreement State specific license with the NRC Regional Office. Also, the Agreement State licensee may be authorized to begin the activity upon notification of the NRC regional office by telephone of the licensee's intent to conduct the proposed activity under the general license.

Contrary to the above requirement, representatives of Oregon State University, an Agreement State licensee, performed activities using licensed materials during May 12 - 14, 1986, in Sinslaw National Forest without filing a Form NRC-241 or being authorized by telephone to conduct the general licensed activities.

This is a Severity Level V Violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, Oregon State University, Corvallis, Oregon, is hereby required to submit to this office within thirty days of the date of this Notice, a written statement of explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
