Dear Mr. Lemley and Mr. Nagel:
I am responding to your October 16,1998, letters to Chairman Jackson, in which you encouraged Nuclear Regulatory Commission (NRC) involvement in matters affecting the future of the Low-Level Radioactive Waste Policy Amendments Act (LLRWPAA). You also sent an identical letter to John Greeves, Director of the Division of Weste Management. You noted that Senator Murkowski, Chairman of the Senate Energy and Natural Resources Committae, recently requested the General Accounting Office (GAO) to eWte progress under the LLRWPAA. He also requested that the GAO examine alternatives to the existing framework for developing new disposal facilities. Your letter included your responses to questions GAO had asked of U.S. Ecology.
We share your concerns about the need for a national framework that ensures safe, efficient, and reliable disposal of commercial low-level radioactive waste (LLW). To that end, NRC has remained firmly committed to the permanent disposal of LLW and the goals of the LLRWPAA, as reflected by NRC's actions and in numerous letters to States, members of Congress, the public, and other government agencies.
With respect to your specific request that we take an active role in the process of reexamining the current system, we have met with GAO staff and expect to provide them with additional information as their study progresses. We also provided information for the May 1995 GAO report, " Radioactive Waste: Status of Commercial Low-Level Waste Disposal Facilities" j
(RCED-95-97) that Senator Murkowski has asked to be updated in this new effort.
