Commonwealth Edison Company 22710 206th Avenue North Cordova, IL 61242 SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NOS. 50 254/97002 'AND 50 265/97002(DRP)) Dear Mr. Kraft: This will acknowledge receipt of your letter, ESK 97-136, dated June 26,1997, in response to the Notice of Violation (NOV) transmitted by letter dated April 25,1997. The NOV cited violation 50 254:265/97002-01 for failure to follow Technical Specifications with regard to operability of reactor protection system (RPS) instrumentation channels. We have reviewed your response and disagre'i with your conclusion that Technical Specifications (TS) were not violated. Our differing conclusions stem frorn how the event involving a spurious trip of RPS relay 1590108D is interpreted. Your response stated that the 108D relay was not inoperable until the shift conservatively declared the relay inoperable at 12:49 p.m. on March 7,1997. It is our position that the relay inoperability was evident when the relay spuriously tripped at 10:47 a.m. on March 7. At that time, operators verified that the channel trip was not valid, however, you did not know the cause of the trip. Although the relay was in its safety position, its operability was unknown, i.e., if it had been immediately retumed to service, its ability to protect the plant would have been in question. Based on the TS action for an inoperable channel, which required that the inoperable channel be placed in the tripped condition within one hour, it is our positior, that:
The two hours taken to reach a conclusion on the operability of the relay was excessive, and
Resetting the relay was contrary to the TS action statement, was not appropriate given what was known at the time, and was not in accordance with Quad Cities Operating Abnormal Procedure 50')-1, " Partial Scram Actuation," which stated, "Do [[QT reset a " half teram" until the cause is I known..." g it is therefore our conclusion that you did not operate the plant in accordance with TS by resetting relay 1080 after the trip when the cause of the trip was unknown. The act of declaring the relay inoperable af ter completing two nours of troubleshooting, rather than - just after the relay tripped, was not conservative. h 9709230077 970915 PDR ADOCK 05000254 G PDR __ I

You should document your reply to our comments in this letter relating to your l origirst response to the Notice, and any additional action you plan to prevent recurrence. After reviewing your response to this letter, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further enforcement l action is necessary to ensure compliance with regulatory requirements, in accordance with 10 CFR 2.790 of the Commissions's regulations, a copy of this letter will be placed in the NRC Public Document Room.
