CLINTON INSPECTION REPORT 50-461/98018 (DRP) AND
NOTICE OF ENFORCEMENT DISCRETION
Dear Mr. MacFarland:
On November 17,' 1998, the NRC completed an inspection at your Clinton Facility. The
enclosed report presents the results of that inspection.
During the 7-week period covered by this inspection report, improvement was noted in the
conduct of program and event assessments by your quality assurance organization. Thorough,

critical assessments _of your corrective action and maintenance rule programs and following the
loss of Division i electrical power were conducted. The corrective action program review, which
'
was independently confirmed by NRC inspectors, identified examples of ineffective program
implementation for level 3 and 4 condition reports. Specific issues identified that were
)
associated with these types of condition reports involved ineffective management oversight,
poor apparent cause analysis, inadequate extent of condition determinations, and ineffective
corrective actions for identified apparent causes.
In addition, we are concerned about two violations of NRC requirements that were identified. In
the first instance, NRC inspectors identified a violation ' involving the failure to perform a hazards
analysis as part of the safety evaluation which was conducted for a temporary modification
used to support Division i emergency core cooling system (ECCS) testing. A hazards analysis
was required by your procedures which contain instructions for performing safety evaluations.
The safety evaluation conducted for the temporary modification did not address the hazards
associated with temporarily installed cables routed in the vicinity of safety-related equipment
that was not being tested as part of the ECCS testing activities. In the second instance, NRC
inspectors identified a violation involving the failure to adhere to procedures that limit your
staff's working hours. Though a violation was identified, recent efforts to limit staff working
hours have been successfulin providing improved management oversight of the program.
= However, I have been authorized, after consultation with the Director, Office of Enforcement,
-and the Acting Regional Administrator, to exercise enforcement discretion for the violations in
accordance with Section Vll.B.2, " Violations Identified During Extended Shutdowns or Work
Stoppages," of the " General Statement of Policy and Procedures for NRC Enforcement

Actions"(Enforcement Policy), and not issue a Notice of Violation in this case. The decision to
apply enforcement discretion is based on consideration of the following: (1) significant NRC
enforcement action has already been taken against the Illinois Power Company for procedure

adequacy and adherence problems, (2) additional enforcement action is not considered
"
necessary to achieve remedial action for the violations due to Clinton Power Station's
commitments in its Plan for Excellence to take actions to address procedural adequacy and
adherence issues prior to plant restart, (3) the violations are related to a problem which was
present prict to the events leading to the shutdown, (4) the violations are not classified at a
Severity Level I, and (5) the violations are not willful. Effective corrective actions for these
issues will need to be demonstrated prior to restart.
