DIABLO CANYON ALLEGATION REVIEW BOARD An Allegation Review Board, comprised of the below listed individuals, was convened on December 16, 1985, to examine and disposition a number of allegations identified below.

A review of the allegations listed on the memo to John Martin, Regional Administrator, from Ron Meeks, 01, dated 08/15/85, including Allegation 1706, was conducted to ascertain the " technical" significance, if any, that warrants further investigation beyond the apparent " civil" issues of harassment, intimidation, etc. All seventy-seven of these were sorted into the four groups designated below. Allegations related to categories I and II were dispositioned in a board meeting held on December 6, 1985. This Board continued with the dispositioning of categories III and IV allegations.

ALLEGATIONS 0250, 0256, 0328, 1597 (0404, 0845, 1599) (0411,0442, 1598) (0412,1000) (0413, 0439, 0769, 1001) 0766, 0809, 0914,1002, 1014, 1024,(1259, 1269, 1609) 1268, 1271, 1323, 1325, 1420,1440, 1442, 1445 (1450, 1470, 1629) (1621, 1622, 1624, 1626)

(Note: Numbers in parenthesis are closely related allegations.)

These allegations can be generally characterized as actions or in-actions by management to intimidate personnel through layoffs, terminations, transfers, demotions and other forms of harassment, including acts or threats of physical harm by other workers, perceived by the allegers to be directed at " corner cutting" and the suppression of quality and safety related concerns. Actions already taken by the staff (reference Safety Evaluation Report, NUREG 0675, Supplement 22) involving several thousand staff man-hours and direct contacts with hundreds of site personnel, specifically addressing these issues, have not revealed any company attitude to foster the kinds of activity alleged.

Further application of NRC resources on these matters is not warranted due to the insignificant technical aspects of some of the allegations and/or the fact that no unresolved technical issues could be identified from the source documents.

ALLEGATIONS CLOSED.

B. ATS RV-84-A-052, ALLEGATION 0592; RV-84-A-064, ALLEGATIONS 0770, and 905; RV 84-A-115, ALLEGATION 1578.

The referenced source documents for these allegations did not adequately support the characterization statements that implied intimidation, nor were there any other significant safety issues not previously identified. It was, therefore, not possible to assess any definitive technical significance to the allegations.

ALLEGATIONS CLOSED.

IV OTHERS

, A. ATS RV-84-A-064, ALLEGATION 0767.

The characterization statement for this allegation when read in context with the source document appears not to have been directed' at wrongdoing, but rather to establish some value to the job that he was performing for the company. As a consequence, the allegation has no substance and is CLOSED.

B. ATS RV-84-A-064, ALLEGATION 0852.

The implication of the characterization statement in the source document is that the company hired unqualified welding inspectors.

The allegation has already been addressed in response to Allegation

  1. 993 in NRC Inspection Reports 50-275/85-35 and 50-323/85-33, dated November 26, 1985. ALLEGATION CLOSED C. ATS RV-84-A-071, ALLEGATION 1210; ATS RV-84-A-091, ALLEGATION 1463 1

The source documents reveal the technical issue addressed by the i

PG&E letter referenced in the characterization statement is related to the carbon level in stainless steel piping and inter-granular stress corrosion cracking phenomena. Other allegations related to this issue have been resolved by the staff. Reference Allegation

ALLEGATIONS CLOSED.

D. ATS RV-85-A-999, ALLEGATION 1706.

9 This allegation clearly exhibits technical significance in that both the material specification and application are provided. However, the allegation has already been addressed and closed by the staff l

(reference NRC Inspection Reports 50-275/84-42 and 50-323/84-31, dated February 5, 1985) in response to Allegation #1541 with regard to the A-307 material. Allegation #1541 has been CLOSED. A response to the allegation concerning the other two materials was prepared by PG&E in DCL 85-212, pp. 108 and 109, dated June 13, 1985. A review of the actions taken by the licensee and the associated documentation (DR 5739, 5891 & 8521 and NCR DCl-84-RM-N010 & 011) reveals proper dispositioning and is acceptable by the staff. ALLEGATION CLOSED.

E. ATS RV-84-A-114, ALLEGATION 1500; ATS RV-84-A-Il5, ALLEGATION 1556 These allegations clearly exhibit technical significance in that specific plant components (Paramount stanchions for Rupture Restraints) associated with the characterization statements are identified. However, this issue was thoroughly evaluated by the staff and documented in NRC Inspection Report 50-275/84-42 dated February 5, 1985 in response to allegation numbers 1473, 1495, 1496, l 1498, 1499, 1526, 1553, 1554 and 1555. (ATS Nos. RV-84-A-078 and 115 . ALLEGATIONS CLOSED.
