Dear Congressman Taylor:
I am responding to your letter of November 10,1998 to Chairman Jackson concerning your constituent, Doug King Associates, Inc., dba Quality Recycling, of Horse Shoe, North Carolina.
As stated in your letter, NRC representatives met with Doug King and representatives of the Department of Energy (DOE) on September 1,1998 in Oak Ridge, Tennessee. We understand that Mr. King may have suffered losses as a result of his firm's activities which were associated with the remediation of the DOE site at Weldon Springs, Missouri and involved dealings with both the DOE and the NRC. This matter, and the circumstances involved, was the subject of a previous letter to you from the NRC, dated April 3,1998.
As discussed with Mr. King at the September 1,1998 meeting, the Federal Government is not liable for the allegedly erroneous advice of its officials or employees unleso Congress has enacted statutes authorizing the payment of such claims. To the best of our knowledge, this claim does not fit within any of the categories where Congress has authorized the payment of claims by NRC. Accordingly, the only means that we are aware of that may permit relief would be a Private Relief Bill or by making a claim to the General Accounting Office under the Meritorious Claims Act. We express no view on whether this situation may present special equitable considerations that would support Congressional relief for his bid and proposal costsc I trust this it responsive to your concerns.
