BON!O IllITIAL DECISION FOR WPPSS 3 & 5 A representative of the Washington Public Service Supply Systen (J. Sorensen) called to request our help in attempting to minimize any future delays in issuance of construction pemits for WPPSS 3 & 5.

Sorensen stated that the only outstanding infomation on the WPPSS 3 & 5 application. the infomation requested by the staff to resolve the landslide question, will be in the reviewer's (H. LeFevre) hands by 2/28/78. Sorensen is aware that LeFevre is scheduled to attend the Skagit hearing beginning 3/6/78 and Sorensen is concerned that if LeFevre cannot complete his review by 3/6/78 the review r.ay be delayed for an additional week or two.

Sorensen stated that the work force has been able to move forward better than expected and as of now they project that they will complete the work allowed under the LUA by 4/7/78. If LeFevre can complete his review and have an affidavit submitted to the Board by 3/6/78, the Board will have a month to i; sue its Initial Decision prior to the field force running out of work. Should LeFevre delay a week or two past 3/6/78,the Board's time will be reduced accordingly thus endangering the field work.

Would you please review the situation with LeFevre assuming that the WPPSS submittal is to you en 2/28/78 and.that the applicant supplies adequate l infomation. We would appreciate a call after you talk with LeFevre.

A r.eetint; was held ca flovember 8,1977 with the applicant and his legal consultant to address this topic. A list of the riceting attendees is shown in Enclosure 1.

The record for the UI!P-3 and HitP-5 hearing is being kept open as a result of two itens: (1) the 1872 Pacific !!arthuest earthquake, ond (2) the faulting uncovered at the H!!P 'l excavation. He have nade a site visit to inspect the faulting of the excavation in Ur.it I!o. 3 and reported in a trip report dated flovenber 3,1977. In addition on Novenber 4,1977, the ACRS concluded a necting addressing the 1872 Pacific liorthwest earthquake as a. generic issue.

ptsscussion The applicant revicued the key construction nilestone dates and the geology /scisnology chronology. Enclosure 2 contains the vu-nraphs presented. The applicant stated that in order for the Unit i;o. 3 commercial operation date of September 1983 be net, a construction pemit is required by Decenber 1,1977. The applicant urecd the staff to proceed with the open itens to the Board, sinct exhaustive infomation is now available en the 1072 earthquake, in order for a decision may be nade to issue the construction pernits. Follouing a discussion, the applicant was requested to provide the following:

(1) Subnit to us, as soon as possible, the technical infomatien requested in a telecon on !!over.>ber 3,1977 and confirned in a letter dated floverlor 9,1977, on the faulting in Unit ::n. 3.

Additionally, an affidavit should be transaitted to the Board with their findings. ,

NOV 16 13, k (2) Prepare an affidavit to the Board addressino a full disclosure of the facts on the 1872 Pacific !!orthwest earthquakt. including

'the staff findings as reported in the SER and the supplencnts; an evaluation of the U. S. Geological Survey position as presented in a letter dated July 21, 1977 on the Skagit docket and its presentation before the ACRS; the ACRS evaluation which will be reported in their letter; and the results of the applicant's and its consultant's investigations.

The first iten is contenplated to be completed approximately by flovember 18, 1977 and the second item, soon after the A",RS letter is issued addressing the earthquake. Once the hbove itens have been subnitted and reviewed by us, we would submit our affidavit with our findings to the Board.
