Dear Mr. Schultz:

By letter dated March 3. 1997. Maine Yankee Atomic Power Company (MYAPC) submitted a response to the NRC's May 31. 1996. request for additional information regarding the integrated containment analysis - methods summary and identification of differences from the standard review plan for the Maine Yankee Atomic Power Station and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.

An af fidavit dated February 3.1997. from Yankee Atomic Electric Company, the owner of the information, was included in the application.

Yankee Atomic Electric Company states that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

"1.

The material contained in this transmittal was obtained at considerable expense to Yankee Atomic Electric Company and Maine Yankee Atomic Power Company and the release of which would seriously affect our competitive position.

2.

The material contained in this transmittal is of the type customarily held in confidence and not customarily disclosed '

We have reviewed your submittal and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of Yankee Atomic Electric Company statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information.

Therefore, we have determined that the document entitled " Maine Yankee Containment Analysis Methods Summary Report. marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954 as amended.

If the need er1ses, we may send copies of this information to our consultants working in this area.

We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information, if the basis ior withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.

You should also understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act recuest includes your information.

In all review situations, if the NRC neecs additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
