APPROVAL TO USE GENERIC LETTER 90-05 GUIDANCE TO TEMPORARILY REPAIR ASME CLASS 3 SERVICE WATER SYSTEM PIPING AT V. C. ,

SUMMER NUCLEAR STATION (TAC NO. MA2107)

Dear Mr. Taylor:

Your May 13,1998, letter submitted a relief request seeking NRC approval to temporarily repair American Society of Mechanical Engineers (ASME) Code Class 3 piping. The piping is 4-inch  ;

carbon steel, moderate-energy, service water (SW) system pipe. l We evaluated your request in accordance with Generic Letter (GL) 90-05 " Guidance for Performing Temporary Non-Code Repair of ASME C'>de Class 1,2, and 3 Piping." We ,

determined that your structural integrity and operability assessments are acceptable, and your l augmented inspections are satisfactory. We find that making an immediate Code repair is j

impractical, since the Class 3 Code repair would require isolating the SW system for longer than the 72-hour Technical Specification (TS) Limiting Condition for Operation (LCO) 3.7.4 action statement allowance. Exceeding the SW system 72-hour LCO action statement requires a plant shutdown. Therefore, in accordance with 10 CFR 50.55a(g)(6)(i), we find that the Code requirements _ are impractical, grant the requested relief, and impose the alternatives, until the next refueling outage (RFO 11) is complete. The relief granted is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest, giving due consideration to the burden upon the licensee if the requirements were ,

imposed on the facility. You indicated that you will perform a Code replacement of the defective i

- piping during the next scheduled outaga exceeding 30 days, or during RFO 11, currently scheduled for the Spring of 1999. The enclosed Safety Evaluation contains our evaluation of
