SUBJECT: NOTICE OF VIOLATION FOR NRC (MERGENCY PREPAREDNESS PROGRAM

INSPECTION REPORT NOS. 50 243,336,423/97 81

Dear Mr. Kenyon:

This refers to the inspection conducted on August 25429,1997 at the Millstone Nuclear

Power Station. The inspection report containing an explanation of the apparent violations

was issued November 24,1997, and the predecisional enforcement conference was held

December 22,1997, at the USNRC Region 1 office, King of Prussia, Pennsylvania. The

enforcement conference was attended by Mr. M. Bowling and other members of your

staff. A list of the attendees is enclosed (Enclosure 1).

Based on the information developed during the inspection and the information that you

provided during the conference, the NRC has determined that violations of NRC

requirements occurred. These vlotations are cited in the enclosed Notice of Violation

(Notice) and the circumstances surrounding them are described in detail in the subject

inspection report.

These violations have been categorized in accordance with the " General Statement of

Policy and Procedure for NRC Enforcement Actions" (Enforcement Policy), NUREG 1600 at

Severity LevelIV. Although taken separately and in the aggregate these violations do not

raise above the level of concern expressed by a severity level IV, we feel that left

unattended they would degrade to a level that could cause further enforcement action. We

are also concerned that a number of them were identified by the NRC.

You are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. In accordance with 10 CFR 2.790 of the

NRC's " Rules of Practice," a copy of this letter, its enclosure ((s), and your response will be

placed in the NRC Public Document Room (PDR).
