An official ERDA/WPPSS agreement has been submitted by WPPSS for staff review and approval (see WNP-1,4 SER, P. 2-2). As this approval is required to go to a radiological safety hearing now scheduled for ,
September 2,1975. I would appreciate your early review of the agreement, which has been distributed tio your offices. ,
Please note that certain rights rese ved by ERDA in the agreement may undermine the applicant's ability to exarcise continuous control over personnel and property within the exclusion area, or may result in the I
installation of potential safety hazards within the exclusion arca, without advance notice to either WPPSS or the NRC. I believe these considerations are primarily matters for AAB and ISEP evaluation. "
OELD is conducting its own evaluation of the document. A meeting with the applicant's attorney is tentatively scheduled for Tuesday, July 29, 1975, at which time preliminary connents will be discussed. Overall staff conclusions will be documented in an SER supplement to be issued before the radiological safety hearing.
