Dear Mr. Chilk:

On May 12, 1986, in an unpublished Memorandum and Order, the Atomic Safety and Licensing Appeal Board dis-missed, as moot, an appeal of Robert L. Anthony from the Licensing Board's denial and dismissal of his petition to intervene in the captioned operating license amendment proceeding. Pursuant to 10 C.F.R. 52.786, the matter is before the Commission.

At the time the application for license amendment was filed in December 1985, it was believed that none of the excess flow check valves which were the subject of the application could be tested without a plant shutdown.

We learned on Thursday, May 15, 1986, that after further evaluation and contact with other facilities, the Licensee concluded that a number of .the valves could be tested during plant operation using additional personnel, special procedures and precautions, and taking into account ALARA requirements; individual reviews of each proposed test assured that only tests which did not affect plant or personnel safety and which were in conformance with the Technical Specifications were conducted; and that testing of 58 of the excess flow check valves was performed in the three weeks prior to the surveillance testing outage begun May 2, 1986. The remaining excess flow check valves are scheduled to be tested during the outage.

The need for the amendment - to defer testing on the balance of the excess flow check valves is unaffected.
