1.0 BACKGROUNO

The Department of Energy (00E) is temporarily in custody of the West Valley site for the purpose of a waste management demonstration project involving the solidification of the liquid high-level' radioactive waste currently in storage on the site.

This action was authorized by the " West Valley Demonstration Project Act" of 1980 (Public Law 96-368).

Included in the Act is the requirement for DOE to dispose of, in accordance with applicable licensing requirements, low-level radioactive waste produced by the solidification of high-level radioactive waste under the project.

The Act also identified an informal review and consultation role for the Nuclear Regulatory Commission (NRC) with respect to the project.

It is expected that DOE will publish an environmental assessment for the disposal of project low-level waste. Disposal options could involve the NRC licensed Facility Discosal Area (FDA).

The FDA at the West Valley site, was used for the burial of radioactive wastes from the former spent 3

fuel reprocessing plant on a nearby part of the site.

The first burials at the FDA occurred in 1966, shortly after the reprocessing plant began to operate, and continued during the operation of the plant.

Current disposal in the FDA has been associated with the maintenance of the plant in its closed down mode.

The NRC plans to provide its remarks on this environmental assessment during the appropriate comment period.

Members of the Environmental Sciences Division staff, Oak Ridge National Laboratory, have provided support for our current FDA activities associated with the West Valley Demonstration Project (WV0P).

They are very familict with characteristics of the FDA and the site in general.

2.0 WORK REQUIRED:

00E has submitted for comment the February 1986 draft of its environmental assessment.

The assessment will identify the purpose of and need for the proposed action, detali the proposed action and estimate its environmental consequences, and estimate the environmental consequences of

4 alternatives to the proposed action. Other pertinent documents related to the review of the DOE assessment will be available for reference.

The performing organization shall receive, then review and comment on, the assessment.

Reviewing the documents shall consist of developing an understanding of the basis for the assessment. Comments shall address the technical reasonableness, effectiveness and completeness of DOE's assessment of the disposal of WV0P's low-level radioactive waste with respect to the health and safety of the public. Of particular importance in this review will be DOE's considerations relative to the use of the FDA or any other on-site location for dispcsal options.

For the radiological impact associated with the proposed action and each alternative, the performing organization shall evaluate the consistency of assumptions, applicability or models and reasonableness of the results.

If the performing organization identifies discrepancies that would invalidate the assessment, they snall either suggest appropriate changes to the methodology or provide an independent evaluation.

3.0 REPORTING REQUIREMENTS:

3.1 Monthly Letter Status Report:

Each month, the performing organization shall submit 3 copies of a brief

letter report which summarizes:

(1) the work performed during the previous month; (2) personnel ~ time expenditures during the previous month; and (3) costs and uncosted obligations, listed separately:

(a) during the previous month, (b) cumulative to date (fiscal year and total), and (c) projection by month to completion of the work effort covered by this statement of work. The first monthly report shall provide the initial projection and subsequent reports shall either indicate revised projections or indicate "no change in the cost and uncosted obligation projection." The report shall be due by the 15th of each month with distribution as follows:

The performing organization shall provide a technical letter report summarizing their comments as described in Section 2.0.

This report shall be presented in draft form to the NRC within 30 days of DOE's formal submittal of their environmental assessment or the effective date of this agreement, whichever is later.

The performing organization shall use information from the environmental assessment documents and information from previous site visits to develop a final report.

Ten copies of the draft technical letter report shall be submitted to Norman H. Davison, NMSS.

i Upun receipt of the draft report, the NRC shall make comments and return it to the performing organization within 20 days. The performing organization shall take these comments into account in preparing final versions of the report. The final report and 10 copies shall be submitted to the NMSS Project Manager within two months after the NRC comments are received.

The reports shali conform to NRC Manual Chaptar 1102, Part IV.

4.0 Meetings and Travel The performing organization shall be prepared to meet with the NRC staff and other interested parties approximately two times during the performance period of this project.

It is expected that one meeting will occur shortly after the performing organization's proposal is accepted.

The other meeting may occur at any time thereafter and shall be scheduled by the NRC in consultation with the performing organization. This meeting shall be with representatives of 00E at West Valley, NY, to discuss the environmental assessment. Prior to this meeting the performing organization shall provide the NMSS Project Manager with a list of 5

specific issues to discuss with 00E representatives.

5.0 NRC-Furnished Material The NRC staff shall provide the performing organization with pertinent reports, correspondence, and other information related to the environmental assessment.

6.0 00E Acquired Material The performing organization must notify the NMSS Project Manager prior to acquistion of any capital, ADP, or word processing equipment.

7.0 Period of Performance Performance under this work shall commence on the effective date of this agreement and to be completed by June 30, 1986, at which time all work shall have been completed and all reports shall have been delivered.

8.0 Key Personnel The NRC staff believes that the work described in this 50W should be performed by the Integrated Analysis and Assessment Section of the Energy Olvision of Oak Ridge National laboratory. The aforementioned Section has

~ unique experience in modeling and assessment of environmental impact.

If the aforementioned Section is or becomes unavailable to perform work, the I

l performing organization may substitute persons with equivalent qualifications subject to approval of the NMSS Project Manager.

If available, it is also requested that Roger 8. Clapp and Stephen E.

Herbes of the Environmental Sciences Division, Oak Ridge National Laboratory, be utilized for the purpose of efficiently executing this S0W.

They have an extensive background in the detailed characteristics of the West Valley site due to past contractuci support with the NRC.

9.0 Technical Direction Norman A. Davison (FTS 427-4205) is designated the NMSS Project Manager (PM) for the purpose of assuring that the services required under this S0W are delivered in accordance herewith. All technical instructions to the DOE performing organization shall be issued through the NMSS PM. As used herein, technical instructions are those which provide details, suggest possible lines of inquiry, or otherwise complete the general scope of work set forth herein.

Technical instructions shall not constitute new assignments of work or changes of such nature as to justify an adjustment in cost or period of performance.

Directions for changes in cost or period of performance will be provided by the 00E Operations Office after receipt of an appropriate Standard Order for DOE Work (50EW) (NRC Form 173) from the Office of NHSS.

If the performing organization receives guidance from the NMSS PM which is believed to be invalid under the criteria cited above, the performing organization shall immediately notify the NMSS PM.

If the NMSS PM and the performing organization are not able to resolve the question within five days, the performing organization shall notify the 00E Operations Office.

10.0 Otsoosal of Property Prior to close out or termination of this project, a reconciled report shall be developed by DOE to record all available equipment and related material purchased with NRC funds.

This report shall be developed as soon as possible after program completion or termination decision has been made, but not later than 60 days after work termination date. The report should be submitted to the NRC Division of Facilitie2 and Operations Support, ADM, and the NMSS PM.

11.0 Level of Effort The estimated level of effort for this project is approximately 0.5 staff years.

12.0 Quality Assurance Procedures For all draft reports delivered under this agreement the performing organization shall ensure that an independent review and verification of all numerical computations and mathematical equations, derivations, and models are performed by qualified contractor personnel other than the original author (s) of the reports.

If the performing organization a

proposes to verify / check less than 100 percent of al? computations and mathematical equations, derivations, and models in '.he report (s), (such as might be the case where there are a large numtar c.'

routine, repetitive calculations), the performing organization must /irst obtain written approval from the NMSS PM. Computer generated calculations will not require verifications when the computer program has already been verified.

All reports, including those which do not contain numerical analyses, must be reviewed by the performing organization's management and approved with i

two signatures, one of which is for the performing organization's management at a level above the program manager.

When revisions of those reports are issued, a section must be included in the revised report to document dates, reasons, and scope of all changes made since the issuance of the original performing organization's approved,

1 report.

NRC has the option of appointing a Peer Group to review the draft report and make changes to the final report.

The performing organization may recommend candidates for the Peer Group for approval by the NMSS PM.

In the occasion of dissent in the content of the final report, the dissenting party will have the option of stating its viewpoints and findings in a section of the report, i
