Subject:
Interagency Agreement No. NRC-10-86-362 Pursuant to the Contract Disputes Act of 1978, the Nuclear Regulatory Commission (NRC) and the Department of Energy (D0E) desire to enter into an agreement whereby DOE will serve as Board of Contract Appeals to settle
-disputes arising under contracts issued by the NRC.
Upon your agreement as provided below, the terms and conditions of this interagency agreement are as follows:
Statement of Work Effective April 1,1986, the Department of Energy Board of Contract Appeals is designated as the cognizant Board to decide disputes referred to it by the Nuclear Regulatory Commission relative to contracts entered into by the Nuclear,, Regulatory Commission pursuant to either the contract's Disputes clause or as is cognizable under the provisions of the Contract Disputes Act of 1978, 41 U.S.C. 601 et seg. The specific responsibilities of the parties to this agreement are outlined in the attached Memorandum of Understanding dated It is further agreed that the Nuclear Regulatory Commission will reimburse the Department of Energy Board of Contract Appeals for all direct costs and reasonable overhead rates allocable to NRC cases before the Board.
In addition, NRC will reimburse the Department of Energy Board of Contract Appeals for costs incurred for court reporting services and/or travel when such is required in a particular Nuclear Regulatory Commission case before the Board.
Period of Performance s
hhe period of performance hereunder shall be from April 1,1986 and shall continue for each succeeding fiscal year until such time as a written notice of termination is submitted by one party to the other.
i If either party desires to terminate this agreement, such termination shall be effective at the end of that fiscal year and a written notice to that effect must be sent to the other party at least 90 days prior to the expiration of the fiscal year.

E. Barclay Van Doren J Obligation of Funds The amount presently obligated with respect to this agreement is
$1,000.00.
Funding for this agreement is chargeable to B&R Number 44-20-25-902 and Appropriation Symbol 31X0200.406.
Method of Pa.yment Payment shall be on a reimbursable quarterly basis with each dispute to be handled as a separate funded task order.
