Dear Mr. Thorne:

Enclosed please find a letter dated April 29, 1986 from Poco Graphite, Inc. with a request for a new flRC export license to replace its previously issued NRC license Xf1AT0306, for which favorable Executive Branch views were received on November 16, 1934.

Export license XMAT0306 authorizes, with certain conditions, the export of 750.0 short tons of nuclear grade graphite to 16 countries over a five-year period for use in various non-nuclear commercial and industrial applications. The new request (X';AT0326), covering the same quantitv of material to the same 16 countries, adds a Poco cwned and operated distribution warehouse in the Netherlands as an intermediate consignee. Under the new license, exports could be made to the 16 countries either directly from Poco Graphite in the United States or through Poco's warehouse in the Netherlands with the sane license conditions as set forth in export license XMAT0306.

Accordingly, Poco has requested an exception to the license conditions to permit the export of large quantities of graphite naterial to its warehouse for distribution purposes.

Before taking action on the license application, we would appreciate your views, in-accordance with established procedures, as to whether the prooosed export meets the applicable criteria in the Atenic Energy Act, as amended by the

Nuclear Non-Proliferation Act of 1978. Poco will return export license Xf1AT0306 to the NRC upon issuance of the new license.
