(] WM-42 CANONSBURG,.FA (NMSS/WM)

The Canonsburg effort is nearing the end of Phase II, with the certification that remedial action is complete. NRC staff is presently reviewing the final certification package from DOE; and expects to provide a concurrence decision to DOE in the next month. The DOE is proceeding with baseline monitoring in

. order to establish action levels to be used during the surveillance and maintenance phase. NRC staff conducted a final on-site inspection (July 23, 1986)-of the site, as well as of the Burrell Township vicinity property. As part of a court decision, NRC must notify, through the Department of Justice, a party of local plaintiffs of any action relating to or leading to NRC licensing of the Canonsburg site.

With respect to the Burrell Township Vicinity Property (VP), NRC staff has documented concerns regarding the adequacy of the present design and what course of action remains for the DOE to satisfy applicable standards. This documentation was transmitted to DOE on. June 25, 1986. The staff responded to Q- - an August 6, 1986 DOE letter on supplemental standards on September 15.-1986.

The letter acknowledged DOE rationale for considering EPA supplemental standards, but caution (d DOE on the extent of contamination. NRC staff reviewed a draft Surveillance and Naintenance Plan for the Burrell VP in support of future licensing, and provided connents to DOE on December 4,1986.

WM-41. SALT LAKE CITY, UTAH (NMSS/WM) 4 Concurrences in the RAP and RAIP have been given and construction is in progress.

All of the tailings and contaminated materials from the Vitro processing site have been moved to the Clive site. Placement of radon barrier has begun at the north end and sides of the pile, with approximately 75% of the barrier placed to date. Placement of the rock cover has begun on the sides of the pile, and work will continue until wini.ar weather sets in. Review of RAP Modification No. 1

Related revisions to the RAIP have been reviewed and comments provided to DOE by letter dated December 9, 1986. Additionally, c preliminary design alternatives study for disposal of additional vicinity pro material in a separate cell adjacent to the tailings pile has been reviewed (perty see issues summary).

WM-58 SHIPROCK, NM (NMSS/WM)

Conditional concurrence in the RAP has been given, and construction is essentially complete. A closing ceremony was held by DOE and the Navajos on October 3, 1986. See the attached issues summary for the status of the n remaining RAP conditional concurrence issue on groundwater. Review of the

't) Shiprock draft Surveillance and Maintenance Plan has been completed and comments sent to DOE. The only remaining work at the site will consist of compiling records for the completion report, and making any changes related to the monitoring program resulting from review of the Draft Surveillance and Maintenance Plan. B 22, 1986 DOE submitted RAP Modification No. 5 (ycontamination letter dated remaining October on the escarpment). On December 3, 1986, NRC concurred in this RAP Mod.

WM-48 CURANGO, CO (URF0)

The Final Remedial Action Plan (RAP), presenting a preferred alternative of relocation to Bodo Canyon, has been reviewed and conditional concurrence was given by letter dated August 26, 1986. The RAIP has been reviewed, and NRC comments have been incorporated into a revised document. The subcontract documents have been received and review comments were forwarded.tn DOE on May 15,1986. On October 1, 1986 NRC staff concurred with DOE's decision to o acquire the Durango site. A groundbreaking ceremony was held on December 8 U 1986, but no construe. tion activity is scheduled until the Spring of 1987.

WM-64 LAKEVIEW, OR (URFO)

NRC/URF0 has completed its review of the EA and RAP, and conditional concurrence was given in June 1986. Concurrence in the Remedial Action Inspection Plan (RAIP) has also been given. The preferred alternative consists of trucking the tailings and other contaminated site material to a site seven road miles NW of its present location. A ground-breaking ceremony was held on July 9, 1986; R. D. Smith of URF0 attended. Excavation and liner construction of both the encapsulation cell and the temporary runeff pond at the disposal site have been completed. However, the runoff pond has been shown to have insufficient capacity, so an additional pond is being contructed.

Approximately 160,000 cubic yards of tailings have been moved to the disposal site. NRC/URF0 staff inspected the construction activities at the site on September 8-9, 1986, and an inspection report was issued on September 17, 1986, t Issues are described in the attached sumary. As of the second week of November, construction was halted for the winter.

WM-60 RIVERTON, WY (NMSS/WM)

The NRC staff has reviewed drafts of the NEPA documentation and the draft RAP.

Thepreferredalternativehadbeenstabilization-in-place (SIP). However, consolidation of the Riverton tailings with an active mill site in the Gas Hills of Wyoming 45 miles away, has been suggested by the State of Wyoming, The project is on hold pending progress in resolving whether to consider this pd suggestion. The State of Wyoming engaged an independent group to provide a third party review of the various options for remedial action for the Riverton UMTRAP waste. The recommendations from this study concluded that SIP can be achieved, although the DOE proposal would require some modification. A meeting between Governor Herschler of Wyoming and P.G. Romatowski of the Department of Energy took place on July 14, 1986 to discuss possible resolutions for the deadlock on disposal of Riverton wastes. As part of a generic review of the feasibility of disposal of UMTRAP wastes at commercial tailings sites, NRC prepared a legal response on June 16, 1986 for the possibility of disposal at the Gas Hills site. URF0 is reviewing the active Gas Hills site's proposed license amendment to accept the Riverton tailings.

WM-61 GUNNISON, CO (NMSS/WM)

Preliminary draft and draft EA's and RAP's presenting a preferred alternative of stabilt:ation-on-site have been reviewed by NRC. In response to NRC staff n review and local and state coments, DOE is revising the EA and RAP to consider U additional alternate sites. Review of a revised EA/ RAP is scheduled to begin in April 1987.

WM-67 AMBROSIA LAKE, NM (URF0)

Initial EA and RAP reviews for Ambrosia Lake have been completed. A meeting between 00E and NRC/URF0 staff was held in late August to discuss coments and present preliminary design information. A test fill has been initiated at the Ambrosia Lake site to monitor magnitude and time-rate of settlement through instrumentation of saturated and unsaturated tailings areas.

WM-73 TUBA CITY, AZ (URF0)

Initial EA review for Tuba City has been completed. NRC staff review of the DRAP, which presented the preferred alternative of SIP, was completed on

i- OCT STATUS REPORT /DG February 26, 1986, and comments were transmitted to DOE. Preliminary design documents and responses to NRC comments were received on August 25,_1986. NRC staff completed the preliminary design review and provided coments to DOE on October 16.-1986. The final RAP / design was received on November 24, 1986 and is presently under review.

WM-63 MEXICAN HAT, UT (URFO)

Initial EA review for Mexican Hat was completed in April and the draft RAP review was completed in May 1986.

WM-65 FALLS CITY, TX (NMSS/WM)

The NRC staff has received and reviewed TAC's data collection subcontracts. The

- preliminary final CADSAR was received on December 11, 1986 and is presently pJ under review.

WM-70 MONUMENT VALLEY, W (URFO) l The initial EA review was Amieted in April,1986. The DRAP was reviewed,  !

and comments were provided to DOE on June 6, 1986. Because of significant flooding and erosion conditions as well as potential foundation problems at the site, NRC staff discouraged SIP and recommended that consideration be given to relocating the pile.

WM-54 GRAND JUNCTION, CO (URFO-EIS;WM-RAP)

The DEIS review began in May 1986, and coments were sent to DOE on July 30, 1986. The draft RAP was received on August 18. Draft coments were provided to DOE on September 18. A site visit was made during the week of September 29. Final coments were sent on October 29, 1986. The PFEIS was q reviewed ~and the staff had no comments which precluded its issuance.

V _ Preliminary design Phase I review is scheduled for January 1987.

WM-66 NATURITA, CO (URFO)

The draft CADSAR was reviewed and coments were transmitted to DOE on July 24, 1986. The draft EA and RAP reviews are scheduled to begin in July 1987.

WM-68 GREEN RIVER, UT (NMSS/WM)

The draft CADSAR was reviewed and preliminary comments were telefaxed to DOE in early July 1986. Formal transmittal of coments took place on July 17, 1986.

A site visit by NRC staff was made during the week of September 29. The final

CADSAR was reviewed and coments were sent to DOE on October 30. In these comments, the NRC staff has cuestioned DOE's decision to limit disposal options to SIP and S05. Significant potential technical problems were identified with respect to these disposal' options.

WM-72 SPOOK, WY (NMSS/WM)

The draft CADSAR was received on November 3,1986, and comments were sent to DOE on November 26. Initial EA and RAP reviews are scheduled to begin in August 1987.

WM-62 RIFLE, C0 (NMSS/WM)

WM-69 MAYBELL, CO (NMSS/WM)

Draft CADSAR review is scheduled to begin in February 1987, and initial EA/ RAP review is scheduled to begin in February 1988.

WM-75 BELFIELD, ND (NMSS/WM)

Draft CADSAR review is scheduled to begin in February 1987, and initial EA/ RAP r review is scheduled to begin in February 1988.

WM-86 SLICK ROCK, CO (NMSS/WM)

The draft CADSAR was received on July 10, 1986. Comments were sent to DOE on August 8. Initial EA/ RAP review is scheduled to begin April 1987.

WM-43 LOWMAN, ID (NMSS/WM)

Draft CADSAR review is scheduled to begin in April 1987, and initial EA/ RAP review is scheduled to begin in April 1988.

OCT STATUS REPORT /DG II. Generic Activities Construction Inspection Procedures: WMLU worked with I&E staff to prepare guidance for the performance of NRC inspections during perfonnance of remedial action construction at inactive tailings sites. IAE manual chapter 2620 nn this subject was issued in final form on March 21, 1986.

NRC Licensino Plan: WMLU has developed a licensing plan for UMTRAP sites which describes procedures for the licensing process. The plan will be transmitted to DOE and other interested parties shortly. Office Director approval to pursue a generic license rulemaking has been obtained, and documentation for EDO approval has been transmitted.

DOE Certification Plan: Further work on the DOE Certifice.cion Plan has been postponed until specifics of the Canonsburg site have been resolved. Due to O uacerteiaty re9ardia9 the te^ 9rouad ater staadards oot has PostPoaed work on the generic plan. Through review of the site-specific reports, NRC will execute its concurrence role in the completion of remedial action at each site.

NRC Standard Review Plan (SRP)/ DOE Technical Approach Document (TAD): The NRC staff has reviewed DOE's TAD, which describes technical approaches and design criteria to be used in preparation of remedial action plans. Comments were transmitted by letter dated February 26, 1986. A Final TAD dated May 1986, has been received and distributed to appropriate staff. Comments from DOE on NRC's SRP have been received and reviewed by approporiate technical staff. A response to comments together with proposed changes to the SRP was sent to DOE l by letter dated May 1,1986. Revision 1 of the SRP will be issued following completion of the erosion protection regulatory guide.

DOE Groundwater Protection Plan: The staff has reviewed DOE's Draft Interim UMTRA Project Water Protection Plan. Coments were transmitted on September 29, 1986. Along with the coments, the NRC staff position on UMTRAP groundwater O reviews was conveyed as follows. On an interim basis, the staff will continue to base reviews on the EPA guidance in 40 CFR 192, Subpart C. However, pending conclusion of EPA's replacement rulemaking, all NRC concurrences on remedial actions will be conditioned to require a-further review against EPA's final groundwater protection requirements.

NRC-DOE Memorandum of Understanding: NRC staff has reviewed and revised the present UMTRA Memorandum of Understanding. The revised (MOU) has been reviewed by management and transmitted with coments to DOE on May 7 -1986. Subsequently, DOE provided an updated proposed revision incorpora2ing some of NRC's recomendations and reflecting the ravised document preparation procedures.

NMSS received this version on July 14, 1986, and has coordinated the review

OCT STATUS REPORT /DG with URFO. NRC and DOE staff have discussed this revision and further NRC concerns by telecon on September 10, 1986. Meetings between DOE and NRC st:ffs have been held to resolve these concerns. A final revision will be sent to NRC for approval.

l l Disposal of Title I Waste at Title 11 Sites: DOE requested NRC's fomal position on disposal of UMTRAP wastes at active uranium mills. OGC(formerly ELD) reviewed the request in light of flexibility in UMTRCA to follow this type of disposal strategy. NRC transmitted the conclusions of the OGC analysis to l DOE on June 16, 1986. The State of Wyoming also requested similar infonnation and has been notified of the NRC response. DOE is evaluating the feasibility of this course of action in light of discussions with NRC and other interested n

V parties. NRC staff briefed Congressional staff on December 8, 1986 with regard to the flexibility of co-disposal.

Transfer of Casework to !'RFO: In light of URFO's increased active site licensing activities (New Mexico Program), much of the program has been returned for NMSS reassignment. At present, all site-specific casework except for Lakeview, Durango, Tuba City. Mexican Hat, Monument Valley, Ambrosia Lake, and Naturita has been reassignee to NMSS. It is expected that all UMTRAP construction, inspection, vicinity property, certification, and licensing work will be carried out by the Denver office in FY 87. Overall program management will remain as a headquarter's function.

DOE Generic Study In a continuing effort to design against potential failures at tailings disposal sites. DOE / TAC is initiating a generic project to standardize extreme meteorological events and study their impacts on 1) long-term moisture of the cover related to O radon exhalation; 2) long-term percolation rates through tailings material; and V 3) upward movement of water (exfiltration) caused by capillary action. Results of the study will aid the TAC in designing covers that can withstand extreme meteorological events, and in assessing long-term impacts to groundwater resources at the UMTRA Project sites. Although the TAC will perform the actual work, they are planning to bring in two experts from either industry or one of the national labs to review the results. In addition, the TAC has requested that the RAC, the State of Colorado and the NRC, each appoint a representative to provide coments and input to the project as it develops. Michael Young will be the NRC representative for this project. The project will begin officially in December and end sometime in the Spring of 1987.
