Enclosed for your concurrence and signature is a Commission pa to 3tf f' Comission approval to publish final amendments to 10 CFR Part 40. Th action is necessary to conform the Commission's rules to standards issued by the lV,7 Environmental Protection Agency (EPA),
Congress mandated that the NRC conform

to the final EPA standards for uranium mill tailings.

This final rulemaking action has been coordinated with the Region IV Uranium Recovery Field Office, the Division of Fuel Cycle and Material Safety, the Division of Rules and Records, the Office of Public Affairs and Sheldon Trubatch, Office of the General Counsel. The Executive Legal Director has no legal objection. The Office of State Programs concurs. No significant disagreements or issues have been identified.
