NRC QUARTERLY REPORT TO CONGRESS ON EMERGENCY PREPAREDNESS January 1, 1986 to March 31, 1986 The 27th NRC status report to Congress on emergency preparedness for nuclear power plants covers the period from January 1 to March 31, 1986.

Tables 1 and 2 provide the status of offsite and onsite emergency planning, respectively, for applicants for an operating license.

Commission decision dates are consistent with those reported to the House Committee on Appropriations, Subcommittee on Energy and Water Development.

For plants for which ccnstruction is complete, the dates shown are for full-power licensing. For the other plants, the dates are those by which the NRC needs the 1

information to act on authorization for fuel loading and low-power operations.

  • On April 17, 1985, the Licensing Board for emergency planning for Shoreham ruled that, although LILC0's offsite emergency plan is generally adequate, LILC0 does not have the legal authority to perform many of the required emergency functions set out in that plan. On August 26, 1985, the Board issued a con-cluding partial initial decision finding that because of LILC0's inability to implement its offsite emergency response plan and because of the refusal of the state and county to cooperate, a full-power license may not be issued for Shoreham. Appeals of the April and August emergency planning decisions were filed with the Appeal Board by LILC0 and the intervenors. On October 18, 1985,

, the Appeal Board upheld the Licensing Board's decision that LILCO does not have the legal authority to implement its offsite emergency plan. By Order on December 19, 1985, the Commission stated that it would set a schedule for review of the determination that LILC0 did not have the legal authority to carry out its emergency plan, after the Appeal Board ruled on the intervenors' appeals from the April and October 1985 Licensing Board decisions. On March 26, 1986, the Appeal Board issued a decision that reversed the Licensing Board's determination in part and remanded the proceeding for further hearings.

Resolution of the offsite emergency planning issue, including the performance of 'an emergency plan exercise, is required before operation above 5 percent power. An exercise of the LILC0 emergency plan was conducted on February 13, 1986. The NRC Region I, in an Exercise Report, reported that the licensee adequately demonstrated its onsite emergency response capabilities. FEMA's preliminary evaluation of the offsite exercise was generally positive with the potential for some deficiencies. The FEMA exercise report is expected in approximately eight weeks following the exercise. Additional delays may occur as a result of a likely hearing of exercise-related issues. On the basis of the above, a realistic forecast of the impact on the licensing process cannot be made at this time.

7 The ASLB deferred hearings at the request of the applicants and the NRC staff until the applicants can respond to outstanding technical issues on construction and design. The applicants have provided a current construction schedule; how-ever, no Connission decision date has been determined.

8 A partial initial decision resolving all but three emergency planning contentions

  • was issued on December 11, 1985. An initial decision on the issue of siren effectiveness is expected by April 1986. Two exercise-related contentions admitted by the Licensing Board have been resolved in favor of the applicant by order dated March 19, 1986.

4 Table 1 (Continued) 9 FEMA has reviewed drafts of state and local plans that were submitted by New

New Hampshire formally submitted emergency plans to FEMA in early December 1985 and February 1986 with the remaining portion expected in May 1986. Hearings on the New Hampshire plans are scheduled to start on July 21, 1986. An exercise involving the applicant and New Hampshire was conducted on February 26, 1986.

Preliminary indications are that a number of deficiencies of the type requiring a remedial exercise may be identified by FEMA. The State of New Hampshire is implementing improvements and corrective actions identified by FEMA as a result of the exercise and plan reviews. These activities regarding the New Hampshire plan do not appear to be on the critical path for licensing. The staff believes that resolution of offsite emergency planning issues has the potential to delay issuance of a full power license, although the length of any such delay cannot realistically be forecast at this time.

10The Board admitted certain contentions including one relating to emergency preparedness; hearings began in October 1985. A decision is tentatively scheduled for August 1986.
