Attached for review is a letter received on November 10,1997 from Mike Broderick, the _

- Oklahoma Program Administrator, that identifies specific licenses that contain a provision for.

the use of source material as an ancillary part of the byproduct materiallicense.

! The letter is being provided as a follow-up to the October 6,1997. telephone conference, _

between Mike Broderick, and staff of the Office of State Programs and the Office of the General

- Counsel, in which we committed to review the Oklahoma proposal to exempt source material L

. from the proposed Agreement with NRC with the exception of uses as an ancillary part of the

. byproduct material license, e.g, depleted uranium for shielding used by industrial radiographers -

and medical licensees. As previously discussed, the State proposes to be the sole regulator for ancillary uses in this category. We request your views regarding whether the approach

proposed by Oklahoma is acceptable and is within the' scope of Section 274 of the Atomic

- Energy Act. _ in order to inform the Commission and provide a timely response to inform the.
