Dear Chairman Fry,

Judge Luepke and Judge Bright:

At the June 7,1984 deposition of Bennett Ramberg, Mr. Cormier inf ormed me of his intention to each of you as soon as he obtained copies of the deposition transcript of Bennett Ramberg.

I obj ected, stating that under the Federal Rules of Civil Procedure and under the Commission's Rules of Practice a deposition transcript is to be used f or the purposes of discovery and, as necessary at hearing, and is not being used for any other purpose by the Board.

I also pointed out that such practice is improper under l

10 C.F.R. 2.740a (e), which provides that only the original i

deposition, as corrected and signed by the deponent, is to be forwarded by registered mail to be lodged with Canmission (or in this case the Licensing Board) to be used only as necessary during the hearing.
