Dear Mr. Denton:
The press reports that on or about June 11, 1984 you issued a low-power testing permit to Union Electric Company.
If that is true, no doubt you were unaware that on that da te there was pending a motion by the joint intervenors for leave to file a supplemental contention respecting financial qualifications, which motion was filed on or shortly af ter April 18, 1984.
As far as the joint intervenors know, that motion has never been granted or denied.
It i's obviously improper to issue a low-power testing permit in the face of unresolved substantial issues.
Until the pending motion is granted or denied, the issuance of the permit is entirely. improper.
