Dear Mr. Rael:

By letter of September 23,1998, the U.S. Department of Energy (DOE) requested that the U.S.

Nuclear Regulatory Commission (NRC) review and approve the Generic Application for

~ Supplemental Standards (GASS) 1or Paved Streets and Alleys within vicinity properties (VPs) of the Uranium Mill Tailings Remedial Action (UMTRA) Project for Rifle, Colorado; Shiprock, New Mexico; Riverton, Wyoming; Green River and Salt Lake City, Utah; and Lakeview, Oregon.

This letter provides the results of the NRC staff's review.

The DOE GASS applies to residual radioactive material (RRM) that has been overlain by paved l

streets and alleys at 78 of the vicinity properties included in the UMTRA Project that are associated with these sites. The total quantity of material to remain on these sites is estimated J

to be 17,757 cubic yards. This estimate is based on limited information because of the cost and safety risk of obtaining additional data for location and characterization of the RRM. DOE has concluded that there are no significant identifiable health risks associated with allowing the i

RRM to remain in place under the paved streets and alleys. Therefore, DOE proposes not to j

remediate the areas under the streets and alleys and to apply supplemental standards based j

- on the high cost of remediation (estimated at over seven million dollars) relative to the long-term l

health benefits, as allowed under Criterion (c) of 40 CFR 192.21.

The NRC staff agrees that the GASS meets the U.S. Environmental Protection Agency's criterion in 40 CFR 192.21(c) for application of supplemental standards, and that it will not be cost effective to initiate a task to excavate RRM from under the paved roads and alleys of these sites unless it becomes necessary to disturb these areas for other reasons. However, the staff considers that there should be some assurance that, if the RRM is excavated when portions of l

the streets or alleys are realigned or abandoned, or when utility lines buried beneath the streets are exposed, some control measures should be present to reduce radiation exposure. The l

supplemental standards data base that DOE will be supplying to the states should assist in l

controlling the exposures, in addition, to ensure that any RRM excavated from beneath the f

l paved streets and alleys VP sites will be disposed of properly, DOE should provide copies of T
