ANSWERS TO APPLICANT'S OFF-SITE EP INTERROGATORIES I BY TiiE TOWN OF SO HAMPTON NOW COMES the Town of South Hampton and answers the Interrogatories directed to it by the Applicant as follows:

I G-4. (a) No.

G-5 (a) No, insofar as Plan refers to a formal written and adopted plan.

There are informal departmental operating precedures.

(b) See above.

(c) There is a Town appointed committee to review the State's Plan prepared for South Hampton.

(d) Not applicable.

G-6. (a) Not insofar as " cooperate" means discussion, or information pertinent to the town.

(b) Based on the Town vote, Town Selectmen, Civil Defense Director, Assistant Civil Defense Director, School Principals and Teachers, Fireman and Fire Chief, Policemen and Police Chief, are directed to not implement the plan, now sometimes called " State of New Hampshire Plan, relating to South Hampton."

(d) Robert A. Backus is the attorney, Town of South Hampton is client.

The nature of the representation concerns radiological emergency planning matters, and litigation relating thereto; the privilege attaches because advice of Attorney Backus was related to the scope of his employment.

G-9. Insofar as legal advice is concerned, the answer is no. The Attorney General's Office has offered informal encouragement and support for our efforts. See SAPL response to this question.

XXX-1 Y es.

XXX-2 Day care providers, schools, campgrounds, voluntary firemen, voluntary Fire Chief, voluntary policemen, including the Chief.

XXX-3 No. The Board of Selectmen has not been asked to sign the current plan.

A prior draft plan did seek the written approval of the Board of Selectmen, but this has been dropped in the most recent version.

XXX-4 No, although South Hampton believes its selectmen and other town officials j have expertise concerning the scope of their duties, and their ability to j adequately meet requirements that may be placed upon them.

, XXXI-4 South Hampton believes that the current roster of volunteers are adequate

, to protect the Town under normal circumstances, provided the Seabrook i' Nuclear Plant is not operating. However, it is assumed - that the j interrogatory refers to " emergency operations" resulting from an accident at Seabrook Station. ,

If that is the case South Hampton contends it would need at least 8 full-

~

time police officers and 20 full-time firemen for support. South Hampton

also notes it does not agree with the assumption that two 12 hour1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> shifts would provide " adequate protection", given the nature of the duties that
might be required of these personnel.

XXXI-5 See XXXI-3. South Hampton contends that based on their conflicting jobs and other duties, all personnel would be unable to respond to an emergency i for a 12-hour shift' each day, again assuming that. the Applileant refers to i " emergency operations" resulting from an accident at Seabrook Station.

XXXI-6 Here it is assumed that an " emergency" refers to any event which would

, result in a call being issued to one or more policemen or firemen for

assistance. In the case of the police department usually only one officer

'j is needed to respond, and -there have been many isntances (too numerous to . mention) where assistance was needed from outside organizations

, (Rockingham County Sheriff's Department, N.H. State Police, etc.) .

I In the case of the fire department, personnel are alerted by a tone on a

, plectron radio, but .if they are not within range (at a distance place of employment, on a business trip, on vacation, etc.) they are not able to ,

i respond. In most " emergencies" (See attached list for 1985) only a portion 1

of the available personnel respond, and this can vary widely. In many emergencies the Town finds it necessary to call on the neighboring Town '

of Amesbury, MA, and in some cases on other towns for. " Mutual Aid."
The Town dobts that any manpower would be available from other towns l in the event of a Seabrook " emergency", and as noted above believes that i many of its own personnel would have duties elsewhere and~ not be able j to respond.

XXXIII-1 Y es.

XXXIII-2 South Hampton has no EOC. The State designated EOC, which South Hampton has not and does not accept, is the Town Hall. It is inadequate in that there is one telephone line (three phones). It is answered only during Selectmen's meetings (twice a month) or when the Town Clerk is in, or when the Library is open, in which case it may be answered by the Librarian. There is no radio in the Town Hall, no communication, no backup power, no accommodations. The Town Hall also serves as the school gymnasium / auditorium. There is a kitchen.

i XXXIII-3 No, because the Town and NHCDA do not agree on who should determine the extent of inadequacies in the Town's RERP, and because the Town has not accepted the Town Hall as an EOC.

XXXIII-4 No. South Hampton does not have either the desire or believe it has an -

obligation to do so.

XXXIII-5 South Hampton does not either desire or have an obligation to have an EOC. For an example, however, of deficiencies, see XXXIII-2 above.

XXXIII-6 See XXXIII-5 above.

XXXIII-7 Y es.

XXXIII-8 Yes. Provided acceptance of equipment 'would not be used, directly or indirectly, or by inference, to support the proposition that South Hampton would implement 'and impose RERP for the Town.

XXXIII-9 No, although South Hampton believes its selectmen and other town officials have expertise concerning the scope of their duties, and their ability to

XXXIV-2 No, because under normal circumstances, this information is not required, and has not been needed. It is also not now available in any formal way.

XXXIV-4 South Hampton has not cooperated, nor, to the best of its knowlege, has it been asked to cooperate.
