HERBEIN REGARDING DEFINITION OF " VALID" AND PRIOR STATEMENT DESIGNATIONS JOHN G.
HERBEIN hereby submits the following comments:
1.
Mr. Herbein has no position or comments regarding Judge Kline's proposed definition of " valid."
2.
Mr. Herbein is unable to designate prior statements at this time.
Due to the large number of state-ments that have been generated by several years of investi-gations, hearings and litigation concerning TMI, and due to problems with the computer into which these statements are being programmed, Mr. Herbein's attorneys have not completed their review of the statements.
In addition, any statements designated will bear only on issues arising in Phase Two of this proceeding, and will be designated well in advance of the initiation of Phase Two.
Thus, Mr. Herbein respectfully wishes to reserve the right to designate prior statements at a later date.
A reasonable extension of time to so designate would be greatly appreciated.
