. NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION UNDitt Ur,ited Statos Enrichment Corporation (EA 97-431)

Docket No. 070-07001 jiukjegi: PROPOSED IMPOSITION OF CIVIL PENALTY - $55,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil )

Penalty in the amount of $55,000 will be issued on or about December 8,1997, to United i States Enrichment Corporation (USEC). This is the first civil penalty action against USEC. l The action is based on a Severity Level lli violation involving 5 examples of failure to maintain control of classified matter (documents, drawings, videotapes, etc.) at the Paduca'1 facility.

In accordance with the Enforcement Policy, a base civil penalty in the amount of $55,000 is considered for a Severity Levelill violation. Because the Paducah facility has been the subject of escalated enforcement actions within the last two inspections, the staff considered whether credit was warranted for both /dentification and Correct /ve Action in accordance with the civil penalty assessment process in Section VI.B.2 of the Enforcement policy. USEC personnel identified the violation; thus, credit for identification is warranted.

However, credit for corrective action is not warranted because immediate corrective action was not taken and substantial prodding by NRC staff was necessary to focus USEC's evaluative and corrective action process in order to obtain comprehen*e corrective actions. As a result, a civil penalty in the base amount of $55,000 is being proposed.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule ofissuance and notification is:

Malling of Notice December 8,1997 Telephone Notification of Licensee December 8,1997 The State of Kentucky will be notified.

The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
