Paris May 27, 1988 Page 2 Board's Order of April 25, 1988, that Licensee produce design specifications as initially completed by its fabricator.
In a telephone conference with the parties the preceding day, the Board had directed Licensee as well to produce a second round of system drawings which counsel informed the Board could arrive any day from the fabricator.
Licensee has now received the second round of system drawings and today is sending a copy to Ms.
Skolnick under separate cover, by Federal Express service with delivery tomorrow.
In accordance with Staff counsel's request, a copy also will be provided to the Staff today at the Three Mile Island site.
In light of the April 25 Order, Licensee takes this occasion to assure the Board that we understand the Board's rulings that the design of the evaporator system is at issue in this case, and we have not sought to elude these rulings.
The filing on February 17 of the System Description and the May 9 summary dis-position affidavit describing the system design reflect Licensee's appreciation that design is at issue.
Licensee never attempted to make a distinction between "design" and "perfor-mance" type specifications, and did not have such a distinction in mind.
We regret that our position concerning NRC license technical specifications led to a misconception.
It was coun-sel's intention in seeking the conference call on May 11 to explain this to the Board.
Not having had an opportunity to explain the matter in that call, we do so now, as the instant production of the second set of drawings concludes this discovery matter.
