The Nuclear Regulatory Commission (NRC) staff has compleud a review of the Department of Energy (DOE) preliminary Final Design and Remedial Action Plen (PAP) and all associated documentation pertinent to the proposed remedial action at the Green River site. This review is documented in the enclosed draft Technical Evaluation Report (TER) which discusses the proposed remedial action and the results of our evaluation.
Staff review of data and designs submitted by DOE for the remedial action at Green River indicates there are still a number of outstanding items. Once the outstanding items have been satisfactorily resc1ved, the NRC will be in a position to provide our concurrence in the_ proposed remedial action. The draft TER documents, all outstanding items and what is needed for resolutica. The open issues' presented in the draft TER are primarily related to the EPA groundwater standard and the radon barrier cover design. A brief outline of p
these open items is presented in Table 1.1 of this TER.

It is essential that all open items of concern be addressed before full l
concurrence on the proposed remedial action can be granted by NRC. However, based on the review to date, we conclude that none of the issues identified would preclude DOE, at their own risk, from proceeding with earth moving and excavation at the site up to the actual disposal of mill tailings.

to the open issues, so as to facilitate remedial actions at the Green River i
