On July 20, 1988, the NRC received DDE's!

responses to emaining open items on the proposed remedial action at the Green-River,qttlfta site. The NRC staff completed their review of DOE's responses and provided informal coment to DOE during ac NRC/D0E meeting held on September 8,1988. The purpose of this letter is to formally transmit the NRC staff comments on the July 20, 1988 submittal.

In general, the NRC review concluded that open item no. 7 has been resolnd.

Resolution of open item no. I can be deferred until immediately before placement j) of the rador, barrier and resolution of open items no. 9, 10, 11, 12, and 13 can be deferred ur.til EPA promulgates final groundwater protection standards.

Open items no. 2,3,4,5,6, and 8 still need to be resolved in order for NRC to provide conditional concurrence for the placement of tailings. Based on discussion between the NRC and DOE during the September 7, 1988 meeting on Green River ACL's and the September 8, T988 meeting on the 13 open items, the NRC understands that DOE intends to resolve items 2, 3, 4, 5 6, and 8 by submitting anapplicationforalternateconcentrationlimits(ACL's!bytheendof Octobe-1989. DOE needs to resolve these open items before placement of tailings and other contaminated materials in the new disposal unit at Green River because i

these items affect the design of the disposal unit. Deferral of the resolution of these issues could result in costly and time consuming backfits to the disposal unit if DOE cannot demonstate that the current design complies with the EPA standards in 40 CFR Part 192, Subparts A-C.

The NRC detailed comments on each of the 13 open iter.s is attached.
