remedial action at the Uranium Mill Tailings Remedial Action (UMTRA ject site in Spook, Wyoming.

In this letter you stated that, based on legal review, DOE has determined that the overburden material, which the Abandoned Mined Lands (AML)programgroposesplacingoverthemilltailings,isnot" residual radioactive material as defined in the Uranium Mill Tailings Remedial Control Act. You asked that we confirm this determination and confine our review to the UMTRA portion of the design. Your letter further states that any contribution to radon flux or groundwater contaminetion from the AML material will not be assessed in the UMTRA documents,ubmitted to NRC for concurrence.

O Ih response, NRC has no legal objection to your determination with respect to the overburden matcrial. As you suggest, the staff will limit its review of cleanup of the Spook site to DOE's remedial action plan and stabilization design. We will consider the AML programs proposed cleanup action only ar, it may adversely affect the UMTRA-related activities.

We consider that our letter to DOE dated June 8,1988 has been adecuately addressed by this correspondence. However, your letter did not adcress the staff's concern regarding DOE's ability to meet the monitoring portion of the EPA ground-water protection standards. We note this issue is addressed in the preliminary final Remedial Action Plan and Site Conceptual Design, which we are presenting in the process of reviewing.
