j Based on our myiew, we are prepared to conditionally concur in DOE'S proposed i
remedial action once DOE has closed two confirmatory items, which are summarized A
in section 1.5 of the draft TER.
DOE needs to document the information or
- U commitments requested for both of these items in the final RAP submitted for our i-conditional concurrence. As noted in the draft TER, these items have been previously discussed with DOE staff.
i In addition to these confirmatory items, NRC staff has identified one open issue.
This issue relates to DOE's deferral of groundwater cleanup until after promulgation of EPA's final groundwater protection standards and is discussed in-i section 5.5 of the draft TER. While NRC staff considers DOE's deferral to be acceptable, it precludes us from being able to fully concur in the proposed remedial action.
Therefore, our concurrence will be conditional until the staff determines that DOE has adequately addressed this issue.
