IV. FEMA objects to any interrogatories that may be considered to request information protected by the attorney-client privilege or the attorney work-product doctrine, and this objection includes present Counsel on the record, past Counsel on the record and for George Jett, formerly FEMA General Counsel, Spence Perry, currently FEMA General Counsel, George W. Watson, Associate General Counsel, and Susan Kantor Bank, Assistant General Counsel, to include comprehensively all their work and work-product presently and in past positions.

V. FEMA objects to all interrogatories insofar as they purport to require information outside the possession, custody or control of FEMA or require FEMA to answer based on documents not prepared or requested by FEMA personnel or contractors, or not considered official records of FEMA.

VI. FEMA has not contacted certain former employees of FEMA or its contractors that may have material information concerning the answers to these interrogatories because it has not arrived at a position concerning its legal

, obligation to do so at this time. These individuals include the following personnel that to the best of FEMA's knowledge are no longer employed by the federal government or its contractors:

VII. FEMA has no knowledge as to whether former employees of the Nuclear Regulatory Commission have material information concerning the subject of these interrogatories, but has made no attempt to contact former NRC employees who may have material information.

VIII. FEMA objects in general to the interrogatories as being overly broad, unduly burdensome, and designed to gain information not relevant and not material to this proceeding. FEMA enters this objection for each and every interrogatory and will for economy not restate the objection in each answer.

IX. FEMA represents that its answers to these Interrogatories have been prepared without the substantial participation of Roger B. Kowleski with whom FEMA is currently involved in other legal proceedings. See Occket Numbers NYO3518610472 and NY34438610475 in the United States Court of Appeals for the Federal Circuit, 717 Madison Place, N.W. Washington, D.C. 20439.

X. FEMA intends to provide the lead role in responding to discovery requests for NRC staff and FEMA contractors for this proceeding. FEMA Counsel has also instructed the Counsel for the Applicant that no documents prepared at the direction or request of FEMA officials, employees, or its contractors may be released without FEMA Counsel being given the right of review and inspection to enter appropriate objections.

XI. FEMA notes that many of its objections are premised on the need to protect in the discovery process its concerns as expressed in its MOTION FOR RECONSIDERATION filed on October 27, 1986. Expedited review by the Board and appropriate revision of its October 3, 1986 Order may alleviate these concerns.

XII. FEMA response to the first interrogatories consists of (1) this general respcnse by FEMA counsel; (2) the numbered answers to the Interrogatories; (3) the Declaration of Philip McIntire; and (4) separate appendix of background / biographical information statements for individuals mentioned in the answers to the interrogatories; (5) attachments related to '

the individual interrogatories numbered 2, 3, 17, 19 and-20; and (6) the appropriate service list.

Resoonse to Interrogatory #7 R. Kowieski, the FEMA Region II RAC chairman at the time of tihe exercise, was the lead FDiA regional official. He was in charge of all technical FEMA regional activities related to the exercise prior to, during, and after the exercise until June 1986.

These activities included oversight on: exercise objectives, exercise scenario, exercise evaluation plan,. FDiA controller plan, FEMA simulator plan, exercise evaluator assignments, preparation of exercise evaluation criticue forms, preparation of participants critique, preparation of public critique "

(with the exception of the Regional Director's Statement), and the preparation of the FEMA report.

The current FEMA Region II RAC chairman is Ihor W. Husar.

Respcnse to Interrogatorv #8 Other than the organizations noted in the response to Interrogatory #5, the following agencies, organizations or entities participated in, reviewed, discussed or received correspondence or documents concerning, preparations for, or the conduct, evaluation or results of, the Exercise: FEMA Headquarters, NRC Headquarters, artl Department of Energy (DOE) Headquarters.

On June 20, 1985, by merorandum of Edward L. Jordan, Director, Division of Emergency Preparedness and Engineerirg Ibsponse, Office of Inspection and Enforcement, NRC, to Richard W. Krina, Assistant Associate Director, Office of Natural and Technological Hazards Prograns, FEMA, the NRC forwarded LIIG's standing request to schedule an exercise for Shoreham.

'Ihe Department of Justice also participated, in the preparation for and institution of U.S. v. Suffolk County.

l The General Accountirg Office (GAO), at the request of Senator Daniel P. I Moynihan, has been reviewing FEMA's' role in the Shoreham exercise.

Theodore Barry and Associates, a consulting firm with Headquarters in Ios -

Argeles, was also involved in the generation'of proposed exercise objectives.

The FEMA contract with TB&A provided for technical assistance, resources and support, consistent with radiological eergency preparedness program policy and regulations to canplete a successful exercise of the LIILO offsite' plan. ,

The followirg individuals fran the above organizations participated in activities related to preparations for or the conduct, evaluation or results of the Shoreham exercise.

FEMA Headquarters

- Dave McLoughlin participated in policy discussions and reviewed exercise documents. He reviewed documents and correspondence and provided advice and counsel to the Associate Director, SLPS.

- Howard Schmidt was generally aware of the exercise planning schedule, but not the full contents of the exercise. He attended a very general.

briefing given by the Regional Assistance Committee (RAC) 01 airman before the exercise. He participated in policy discussions, reviewed correspondence and provided advice and counsel to the Associate Director, SLPS. He also participated in a few meetings and conversations involving LII G representatives as Special Assistant to the Associate Director.

- Robert Wilkerson served as the senior headquarters executive responsible for defining options for and then designing the Shoreham exercise. He participated in sone internal meetings and conversations related to the exercise. He also participated in several sessions and discussions involviry both LIILO and Suffolk County officials. Because  ;

of these pre-exercise activities, Mr. Wilkerson renoved himself from i his normal roles of coordinating the evaluation and reviewing the exercise report.

Response to Interrogatory #8 (cont'd)

- Richard W. Krima received the June 20, 1985 memorandum frm NRC transmitting LIICO's standing request for an exercise. However, due to his role in the exercise report review process, he was not further involved in the preparations for or the actual condact of the exercise.

I - Marshall Sanders served as the contract manager with 'Iheodore Barry and Associates. He was a policy advisor in planning for the exercise. He

also served as a liaison with NRC on two issues
exercise' simulation and planning for controllers.

- James 'Ihmas' participation in the exercise consisted of playing the role of the Deputy County Executive at the LILCD Emergency Operating Center. (Also listed in the response to Interrogatory #5)

- Vern Wingert participated in planning activities for the exercise related to his role in the exercise. He was an exercise simulator during the exercise playing the role of a New York State Health Ccmnissioner. - .

(Also listed in the response to Interrogatory #3)

- Bill McAda attended the February 13 exercise, not as an official FDiA , ,

observer or participant, but rather to get a " feel" for media interest since the Office of Public Affairs had much to do with Shorehan media inquiries.

- Spence Perry offered general legal support, as appropriate, in an atmosphere in which litigation was anticipated and, in fact, took place. He also attended the exercise as an unofficial observer, due to the unique legal issues involved with the Shoreham case.

- George Watson offered general legal support, as apptcpriate, in an atmosphere in which litigation was anticipated and, in fact, took l place.

- Susan Bank represented FDiA in preparation for and institution of U.S. v. Suffolk County; coordinated FDIA's legal position with the U.S. Department of Justice and NRC.

i - Craig Wingo participated in sone internal meetings and conversations at FEMA Headquarters on the 1986 exercise. Most of his activity was related to securing resources for the conduct of the exercise.

- Margaret Lawless participated in some internal meetings and conversations at FEMA Headquarters on the 1986 exercise; was also involved in preparing testimony, and background material for the hearings related to the issue of an exercise for Shoreham; also reviewed and coordinated prepara-tion of correspondence on the. exercise issue as it was received in FEMA-Headquarters.-

Department of Energy

- Mayo Lee attended the Shorehm exercise in an unofficial role, for information gathering, due to the unique legal issues ' involved with the plan's implementation and the conduct of the exercise. i

- Mary Ann Novak attended the Shoreham exercise in an unofficial role, for information gathering on aspects of generic interest and to observe the coordination of the Department of Energy's (DOE) involvement in various aspects of the exercise. . In addition, she coordinated the provision of additional DOE laboratory resources for the conduct of the ,.

exercise.

Department of Justice

- Raphel Gomez represented the the Department of Justice in preparation

for and institution of U.S. v. Suffolk County.

General Accounting Office

- Yvonne C. Pufahl, Evaluator, U. S. General Accounting Office, Washington, D.C., serves as a principal staff menber in obtaining information in GAO's review of FDIA's role in the Shorehm exercise.

Nuclear Regulatory Comission

- Sherwin 'Ibrk, Bernard M. Bordenick and Edward L. Jordan attended the exercise as unofficial observers, due to the unique legal issues involved with the Shoreham case.

The FEMA Command Post, including P..Cammarata in the LERO EOC, was used as a central point of contact for all FEMA evaluators and FEMA controllers.

Evaluators and Controllers used this group to pass questions and to facilitate the evaluation process. The command post personnel had no responsibility insofar as the evaluation process was cdncerned. For other personnel included in the FEMA Command Post, see the response to Interrogatory 5.

Response to Interrogatory 13 American Red Cross personnel participa.ted at four (4) locations during the exercise. These locations were: The LERO EOC, the reception center, and the two congregate centers which were demonstrated. The number of American Red Cross personnel were: at the EOC - one (1), at the reception center - six (6), at each congregate care center - three (3).

The federal evaluators observed simulated activities which would have been needed in a real emergency. The evaluators also observed the manner manner in which the participants followed appropriate procedures.

Response to Interrogatory 17 FEMA finds that the inclusion of " response to a Shoreham emergency" and "the LILCO plan" to the scope of the interrogatory is overly broad and burdensome, since the routine conversations and communications relating to these areas covered by the sections of the interrogatory extend over a period of about two years. For that reason, on advice of Counsel, FEMA declines to provide information covering these areas.

Response to Interrogatorv 419 In late August 1986, there were telephone conversations between Richard Krimn, FEMA and Edward Jordan, NRC concerning FEMA's review of the LIILO offsite plan revisions and responses to the exercise report. Essentially, FEMA wanted to review the LIEF 0 responses, Revision 7 and the subsequently subnitted Revision 8 at the same time. 'Iherefore, NRC was asked to provide FEMA with Revision 8 as soon as possible. ' Discussions also dealt with when FEMA could conplete its review of the LIICO responses, Revisions 7 and 8 and provide NRC with the review results. A conpletion/ delivery date in November was discussed.

During the week of Sectanber 19, 1986, there were telephone consultations between FDiA Headquarters and FEMA Region II staff and further conversations ,

between Richard Krimn, FEMA and Shelly Schwartz, NRC and Edward Jordan, NRC l concerning FENA's review of the LIIf0 responses Revisions 7 and 8. During this time, the date when FEMA would provide review ccments to NRC was finalized as December 15. ,
