Dear Mr. Lohaus:

I have received your letter dated December 16, 1997 regarding the review of Kentucky Administrative Regulations 902 KAR 100:010, 015, 019, and 021. These regulations contain NRC's Part 20 equivalent rules.

Our definitions are included in a separate regulation, 902 KAR 100:010, rather than being a part of 902 KAR 100:019. This regulation was in the process of being revised prior to receipt of your comments. This revision should be adopted no later than December 31, 1998 and will satisfy the first two (2) comments in Enclosure 3 and the minor comment in your letter.

The third comment in Enclosure 3 is in regards to 902 KAR 100:019, Standards for Protection Against Radiation. This regulation was submitted earlier this month for adoption of revisions regarding patient release criteria and air constraints. If an amendment to this revision is requested, the typographical error will be corrected and should be effective by June 31, 1998. If we choose to do a separate revision, then the correction will be made and will become effective by December 31, 1998.

If any of these adoptions occur earlier than stated in this letter, we will notify your office.
