Dear Mr. Fairtile:

Pursuant to 10 CFR 50.90 of the Commission's Rules and Regulations, Yankee Atomic E!ectric Company (YAEC) requests that the U.S. Nuclear Regulatory Commission (NRC) issue a license amendment to approve the Yankee Nuclear Po,ver Station (YNPS) License Termination Plan (Reference (b)). This request is in re,sppnse to Reference (c) and is consistent with 10 CFR 50.82(a)(10).

'f(l l). The License Termination Plan, dated May 15,1997, and as revised December 18, 1997, is approved by License Amendment No.

The licensee shallimplement

' and maintain in effect all provisions of the approved License Termination Plan,

which shall be a supplement to the Final Safety Analysis Report in accordance with 10 CFR 50.82(aX9Xi)._ The licensee may make changes to the approved License Termination Plan provided the changes do'not:

(a)

- involve an unreviewed s'afety question as defined in 10 CFR 50.59, (b) violate the criteria of 10 CFR 50.82(aX6),

(c)-

reduce the required final status survey frequency for a specific classification of survey area, (d) increase the action levels for reclassification or remediation, or T

(c) affect the methodology for statistical treatment of final status survey data in a manner which reduces the confidence that the site meets the criteria for unrestricted use."

REASON AND BASIS FOR CHANGE l

YAEC permanently ceased power operations of YNPS on February 26,1992. The objective of decommissioning at YNPS is to remove the nuclear facility safely from service and to reduce i

e residual radioactivity to a level tn permits release of the site for unrestricted use.. in accordance with 10 CFR 50.82(a), approval w 6. ' icense Termination Plan by license amendment is a prerequisite for terminating the license and accomplishing this objective.

The proposed license amendment will ensure that the remainder of decommissioning activities will be performed in accordance with NRC regulations, will not be inimical to the common defense and security or to the health and safety of the public, and will not have a significant efYect on the quality of the environment. The License Termination Plan (Reference (b))

conforms to the requirements of 10 CFR 50.82(aX9). Most of the required elements of the License Termination Pian have been previously addressed by the approved YNPS-

' Decommissioning Plan (Reference (d))'and the. approved YNPS Decommissioning.

Environmental Report (Reference (c)). To satisfy a commitment to the NRC, the approved -

Decommissioning Plan was incorporated into the Final Safety Analysis Report (FSAR) in June 1995c New information contained in the License Termination Plan is only intended to_ update the information provided in these documents and does not change their provisions or conclusions.

consistent with the criteria identified in the Site Decommissioning Management Plan (SDMP)

Action Plan of April 16,1992 (57 FR 13389), and therefore comply with 10 CFR 20.1401.

Overall, the License Termination Plan demcastrates that:

(1) there are adequate funds to complete decommissioning and release the site for unrestricted use, (2) the site relcare criteria ensure that exposure to residual levels of radiation is kept As Low As is Reasonably Achievable (ALARA), and (3) the final sta'.us survey program is adequate to verify that the release criteria have been met.

' SIGNIFICANT IIAZ ARDS CONSIDERATION ne change described above is necessary to achieve the decommissioning objective of terminating the license and releasing the site for unrestricted use. As such, the proposed change will not:

Involve a significant increase in the probability or consequences of an accident previously evaluated. Accident analyses are included in the approved Decomialssioning Plan and incorporated into the FSAR. All decommissioning and fuel storage activities described in the License Termination Plan are consistent with those in the approved Decommissioning Plan. No systems, structures, or components that could initiate or be required to mitigate the consequences of an accident are affected by the paposed change in any way not previously evaluated in the approved Decommissioning Plan. Therefore, the proposed change is administrative m nature and does not involve an increase in the probability or consequences of an accident previously evaluated.

2.

Create the possibility of a new or different kind of accident from any accident previously evaluated. Accident analyses are included in the approved Decommissioning Plan and are incorporated into the FSAR. All decommissioning and fuel storage activities described in the License Tennination Plan are consistent with those in the approved Decommissioning Plan. The proposed change does not affect plant systems, structures, or components in any way not previously evaluated in the approved Decommissioning Plan, and no new or different failure modes will be created. Therefore, the proposed change is administrative in nature and does not creme the possibility of a new or different kind of accident from any previously evaluated.

Involve a significant reduction in a margin of safety. Approval of the License Termination Plan by license amendment is administrative in nature since all decommissioning and fuel storage activities described in the License Termination Plan are consistent with those in the approved Decommissioning Plan. Therefore, the proposed change does not involve a significant reduction in a margin of safety.

ENY)RONMENTAL EVALUATION -

Jihe Decommissioning Environmental Report, prepared and submitted in conjunction with the Decommissioning Plan and approved by the NRC, concluded that decommissioning activities

- would be accomplished with no significant adverse environmental impacts. The License -

Termination Plan evaluates this conclusion and determines that there is no new information or i

significant environmental change associated witia license termination activities.

The proposed change to the license does not involve a significant hazards consideration, does not -

increase the types and amounts of efTluents that may be released off site, and does not increase

' individual or cumulative occupational radiation exposures. Hence, the propor-4 change meets -

the criteria delineated in 10 CFR 51.22(c)(9) for a categorical exclusion from the requirement of an environmental impact statement.

ScimnULE OF CIIANGE Yankee plans to conduct final status surveys beginning in January 1998. As in our letter of May 15,1997 (Reference (b)), Yankee requests that this change be approved by February 16,1998.

This proposed change has been reviewed by the Plant Operations Review Committee and the Nuclear Safety Audit and Review Committee and was determined not to involve a significant hazards consideration.
