I This is in response to your letter dated September 28, 1978 in which you requested, pursuant to the Freedom of Information Act, a copy of the i

successful proposal submitted in response to NRC RFP RS-77-67, " Survey of NRC IE Employees".

Your letter was received by the Office of Admini-stration on October 3,1978.

1 The Division of Contracts will contact you directly regarding your request for a debriefing.

1 Opinion Research Corporation's (ORC) business proposal and portions of i

their technical proposal contain information which is proprietary, and i

this information is being withheld from public disclosure pursuant to i

exemption (4) of the Freedom of Information Act (5 U.S.C. 552 (b)(4))

and 10 CFR 9.5(a)(4) of the Commission's regulations.

A copy of the j

non-proprietary portions of the ORC technical proposal is enclosed.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or i

j disclost e, and that its production or disclosure is contrary to the public ii,erest.

The persons responsible for this denial are the j

undersigned and Mr. Edward L. Halman, Director, Division of Contracts.

i This denial may be appealed to the Commission's Executive Director for

}

Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the t

Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
