Dear Mr. Miller:

This refers to the Nuclear Criticality Safety (NCS) inspection by members of the Headquarters stafTconducted on February 9 - 13,1998, at your Paducah, Kentucky facility. The purpose of the inspection was to determme whether activities authorized by your certificate were cond e.ed safely and in accordance with NRC requirements. At the conclusion of the inspection, the findings were discussed with those members of your staff identified in the report (Enclosure 2).

Areas examined are identified in the enclosed report. Within these areas, the inspection consisted of a review of NCS related Compliance Plan Issue closure. In addition to resiewing completion of compliance plan criticality issues, the inspectors took a broad programmatic look at the Paducah NCS program to gain an understanding of the status of criticality safW program implementation and issue resolution. During the inspection, a violation war .fied as described in the Notice of Violation (Enclosure 1)

The violation involved the failure to flowdown NCS Analysis requirements to procedures. This violation is of concern and is being cited because it involves the failure to identify and flowdown an adequate criticality safety basis in your facility.

You are required to respond to this letter and should follow the instructions in the enclosed Notice when preparing your response. In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. Your response may reference or include previous docketed correspondence, if the correspondence adequately addressed the required response. After reviewing your response to the Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
