APPENDIX A NOTICE OF VIOLATION Gulf States Utilities Docket: 50-458 River Bend Station License: NPF-47 During an NRC inspection conducted on February 1 through March 15, 1986, two violations of NRC requirements were identified. The violations involved improper dispositioning of a startup test deficiency and failure of the quality assurance audit program. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985),

the viol 1tions are listed below:

A. Improper Disposition of Startup Test Deficiency 10 CFR 50, Appendix B, Criterion XI, requires'that test results be documented and evaluated to assure that test requirements have been satisfied.

Quality Assurance Directive QAD-11, " Test Control," Revision 4, implements this requirement by stating that test results shall be documented, evaluated, and their acceptability determined by a qualified individual or group to assure compliance with design and performance requirements. The evaluation shall determine that any nonconforming incident conditions are reported, properly dispositioned, and corrected.

Contrary to the above, Test Exception 1 to Startup Test ST-31, " Loss of Offsite Power," was improperly dispositioned and closed by the Facility Review Committee (FRC) on February 6, 1986, in that the basis for disposition and closure of Test Exception 1 was Nuclear Plant Engineering's (NUPE) analysis and corrective action recommendation for condition report 85-0622, which was based on an unsigned and unverified evaluation provided by Stone and Webster.

This is a Severity Level IV violation (Supplement I.D.) (458/8608-01).

B. Failure to Schedule an Audit Early in the Life of an Activity 10 CFR 50, Appendix B, Criterion XVIII requires that a comprehensive system of planned and periodic audits shall be carried out to verify compliance with all aspects of the quality assurance program and to determine the effectiveness of the program.

Quality Assurance Directive, QAD-18, Audits," Revision 3, implements this by stating that audits be initiated as early as possible in the life of an activity to assure timely implementation of the QA program requirements.

Contrary to the above, on March 5,1986, it was found that activities conducted by the Facility Review Committee (FRC) for review of the startup kDOCk 5 hhk $8 G

test results were not scheduled to be audited early in the life of the program. The program began at fuel load (August 1985) and the 1986 quality assurance (QA) audit schedule for FRC activities was to be conducted for the first time in October 1986 after the scheduled completion of the startup program.

This is a Severity Level IV violation (Supplement I. D.) (458/8608-02).

Pursuant to the provisions of 10 CFR 2.201, Gulf States Utilities is hereby required to submit to this office within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including for each violation: (1) the reason for the violations if admitted, (2) the corrective steps which have been taken and the results achieve, (3) the corrective steps which will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
