Resuming U.S. Nuclear Regulatory Commission (NRC)-Conducted Force-on-Force (FOF)

Exercises During the COVID-19 Public Health Emergency (PHE)

Date of Meeting: Thursday, July 9, 2020 Location: Teleconference Type of Meeting: Category 2 Public Meeting Purpose of the Meeting: The purpose of this meeting was to have discussions with Nuclear Energy Institute (NEI) and industry stakeholders regarding the considerations for resumption of NRC-conducted FOF exercises and the plan for FOF inspection activities during the COVID-19 PHE.

The office of Nuclear Security and Incident Response (NSIR) staff hosted a public meeting with representatives from NEI, NextEra, Entergy, the Union of Concerned Scientists, and the other relevant stakeholders to discuss the considerations for resumption of NRC-conducted FOF exercises and the plan for FOF inspection activities during the COVID-19 PHE. During the meeting, licensees and industry representatives expressed concerns related to resuming certain FOF inspection activities given the anticipated duration of the PHE and the need to protect the health of security personnel. NSIR staff discussed considerations for resuming inspections and potential measures that could be implemented to mitigate certain safety concerns, as well as the staffs proposed path forward. NRC staff also identified that multiple factors would be considered in making decisions regarding the resumption and prioritization of inspection activities, including State, local, and site-specific conditions.

Summary of Presentation:

During this meeting, the NRC provided a brief overview of the NRC actions taken regarding FOF inspections during the PHE and the NRCs criteria for resuming FOF inspections. NRC staff then gave a summary of the NRCs proposed plan for an alternative inspection during the PHE, which would include limited scope tactical response drills. The alternative inspection would be implemented in accordance with Inspection Manual Chapter (IMC) 2201, Appendix C, which provides instructions for developing procedures for an infrequently performed inspections

that can be implemented in response to events. NRC staff also discussed potential options for optimizing the use of social distancing during the IMC 2201 Appendix C inspection. The meeting was then opened for discussion and questions from NRC staff, industry representatives, and public stakeholders.

Action Items/Next Steps:

  • NRC staff will evaluate the information presented during the meeting to determine the appropriate level of oversight while still maintaining the health of the NRC and site personnel.
  • NRC staff plans to finalize the IMC 2201 Appendix C procedure and move forward with management review and approval.
  • NRC staff will continue to engage industry, as needed, to continue to refine considerations for the resumption of FOF exercises under IP 71130.03.
