Dear Mr. Ravenscroft:

i This io in response to your letter dated ' February 12,1999, requesting the status of the Port of

Charleston, Charleston, South Carolina, and approved rail and highway routes from Charleston, South Carolina, to the DOE Savannah River Site for the import of foreign research reactor fuel.

The Nuclear Regulatory Commission (NRC) previously approved the use of the Charleston Port and altemate rail routes (No.185) on September 17,- 1998, facilities for two years.and approved The the primary (No.192) was approved on June 8,1998, highway route for two ye may use the post and routes until they expire, provided you comply with the enclosed route approvals, and the applicable regulations of 10 CFR 73.37(e) for sea shipments,73.37(d) for rail shipments, and 73,37(c) for road shipments.

NRC staff have completed the arrangements with law enforcement agencies required by 10 CFR 73.37(b)(6) for the rail and road routes, information on these arrangements is provided in Enclosures 2 and 3 for each rail route and in Enclosure 2 of the highway route and needs to be .

Incorporated into your shipment plans and provided to our carrier along with instructions for sea, rail and road regarding its use. Subparagraphs 10 CFR 73.37(e)(1),y(d)(1) and (c) shipments, respectively, require armed escorts for the urbanized area o who have the communication capabi)lity to summon assistance in case of an emergenc our understanding you plan to have armed escorts accompany the entire shipment if by rail.

The notification requirements of 10 CFR 73.37(f) and 73.72, and the information protection requirement of 10 CFR 73.21, apply for each shipment made under these approvals. When neking noti 6 cation to this office under 10 CFR 73.72, please confirm that the appropriate gc,vemor or designee will be or has been notified.

Dear Mr. Ravenscroft:

, This is in response to your lette sted February 12,1999 requesting the use of the Port of Charleston, Charleston, South Ca fina, and approved rail and highway routes from Charleston, South Carolina, to the DOE Savann River Site for the import of foreign research reactor fuel.

The Port of Charleston meets the regul ry requirements in accordance with 10 CFR 73.37 and is approved until September 17,2000.

The primary and alternate rail routes (#185) a the highway route (#192), as set forth in Enclosure 1 of each route, meet the regulatory uirements of 10 CFR 73.37. Enclosures 2 and 3 of each rail route const:tutes the route app val These route approvals will expire September 17,2000. Enclosure 2 of route No.19 natitutes approval for this route.
