June 30,1999 UNOPPOSED MOTION FOR EXTENSION OF TIME TO RESPOND TO

SUMMARY

DISPOSITION MOTION ON CONTENTIONS F/P The State of Utah hereby requests an extension from July 1,1999, untilJuly 6, 1999, to file its response to the Applicant's Motion for Summary Disposition of Contentions F & P - Training and Certification (dated June 11,1999). The extension is needed because the State and the Applicant have entered into settlement negotiations, which appear likely to result in the resolution of Contentions F & P.

However, the parties need additional time to conclude the negotiations. This motion is unopposed.

The State is aware that the Board has instructed that extension motions should i

be filed at least three days prior to deadlines, but was unable to do so in this case. The State submits that an extension is appropriate nevertheless, because (1) it amounts to only two business days; (2) the Applicant, Staff, and the State all agree to the extension; and (3) the extension is likely to result in the resolution of the contention.
