1. Convention. Hugh Thompson, Chair of the Management Review Board (MRB), j convened the meeting at 10:00 a.m. Introductions of the attendees were conducted. j
2. New Business. Oregon Review introduction. Mr. Thomas O'Brien, OSP, led the integrated Materials Performance Evaluation Program (IMPEP) team for the Oregon ,

review.  !

i Mr. O'Brien discussed how the review was conducted. Preliminary work included a review of Oregon's response to the IMPEP questionnaire. The onsite review was conducted August 10-13,1998. The onsite review included an entrance interview, detailed audits of a representative sample of completed licensing actions and inspections, and follow-up discussions with staff and management. Following the review, the team issued a draft report on September 16,1998; received Oregon's comment letter dated September 30,1998; and submitted a proposed final report to the MRB on October 2,1998.

Common Performance indicators. Mr. Bunn discussed the findings for the common performance indicator, Status of the Materials inspection Program. His presentation corresponded to Section 3.1 of the IMPEP report. The review team found Oregon's performance with respect to this indicator " satisfactory with recommendations for improvement," and made one recommendation and one suggestion. The MRB discussed the basis for the " satisfactory with recommendation for improvement" finding with the team. The review team based their finding on a strict reading of Management Directive 5.6 and on the State's completion of 41 initial inspections within 7 months instead of 6 months. Both the review team and Mr. Paris noted that there were no l performance issues associated with the additional time taken to complete the initial i

inspection. The MRB directed the review team to revise the report to state that Oregon's performance met the standard for " satisfactory" rating for this ind'cator. The MRB directed that IMPEP teams incorporate flexibility in the evaluation of tae Status of the Materials inspection Program. Mrs. Schneider stated that flexibility would be discussed in the next IMPEP training course and with IMPEP teams. The MRB also

t agreed that Oregon's program to track registered general licenses devices should be recognized as a good practice. '

Mr. Bunn discussed the findings for the common performance indicator, Technical Quality of Inspections, which are summarized in Section 3.2 of the report. The team found that Oregon's performance on this indicator was " satisfactory," and made one suggestion as documented in the report. The review team recommended that the '

unique method for educating the licensees about Oregon's regulations as they pertain to the licensees' operation be considered a good practice along with the form documenting the inspectors " vertical slice" approach to their inspections where several types of radioactive sources are tracked from their receipt on through to disposal. The MRB discussed with the review team the unique aspect of the Oregon approach for documenting and sharing the information with licensees and directed the final report to be revised to reflect the unique aspect of the approach and agreed that this practice be considered a good practice. The MRB agreed that Oregon's performance met the standard for a " satisfactory" rating for this indicator.

Mr. O'Brien presented the findings regarding the common performance indicator, Technical Staffing and Training. His presentation corresponded to Section 3.3 of the -

IMPEP report. The team found that Oregon's performance with respect to this indicator was " satisfactory," and made one recommendation and three suggestions. The MRB, the team, and the State discussed the staff turnover, State's fee system, and Year 2000 i (Y2K) issues. The MRB agreed that Oregon's performance met the standard for a

" satisfactory" rating for this indicator.

Mr. Woodruff presented the findings regarding the common performance indicator, Technicai 0uality of Licensing Actions. He summarized the findings in Section 3.4 of the report. The IMPEP team found Oregon's performance to be " satisfactory" for this indicator and made one recommendation and one suggestion. The MRB agreed that Oregon's performance met the standard for a " satisfactory" rating for this indicator. l Ms. Merchant presented the findings regarding the final common performance indicator, Response to incidents and Allegations. As discussed in Section 3.5 of the report, the team found Oregon's performance relative to this indicator to be " satisfactory" and made one recommendation and one suggestion. The MRB discussed the issue of confidentiality and transfer of information to the State. The MRB agreed that Oregon's performance met the standard for a " satisfactory" rating for this indicator.

Non-Common Performance Indicators. Mr. O'Brien led the discussion of the non-common performance indicator, Legislation and Program Elements Required for Compatibility, which is summarized in Section 4.1 of the report. The team found Oregon's performance relative to this indicator to be " satisfactory," and made two recommendations. The MRB discussed with Mr. Paris the process of promulgating regulations, uses of licensing conditions and adoption by reference. Mrs. Schneider I

noted that two regulations previously listed were category D under the Adequacy and 1

! l Compatibility policy and would be deleted from the report. The MRB agreed that j Oregon's performance for this indicator met the standard for a " satisfactory" rating.  ;

MRB Consultation / Comments on issuance of Report. Mr. O'Brien concluded, based on the discussion and direction of the MRB, that Oregon's program was rated

" satisfactory" on all common performance indicators and non-common performance

. indicators. The MRB found the Oregon program to be adequate to protect public health ,

and safety and compatible. The IMPEP team and MRB agreed that the next IMPEP review for Oregon be conducted in four years.

Comments from IMPEP Team Members. Mr. Bunn noted that this was his last review. He believes that the process is working well and has leamed much. l Comments from the State of Oregon. Mr. Paris credited his staff for the program's  !

status. He noted that he has participated in IMPEP as an OAS liaison and that the significant changes since 1995 have been beneficial to the review process.

3. Old Business. Approval of the Previous MRB Minutes. The minutes from l August 18,1998 New York and September 8,1998 Kansas MRB meetings were offered l for approval. The minutes were approved.
4. Status of Remaining Reviews. Mrs. Schneider briefly reported on the status of the current and upcoming IMPEP reviews and reports. ,

5. Adjournment. The meeting was adjourned at approximately 11:30 a.m.
