Supplementary information: Enclosed for your information is a copy of a Staff Requirements Memorandum, dated September 4,1998, on SECY-98-175, that presents the final Commission guidelines for Appendix C, "Other Events of interest," to NUREG-0090, Abnormal Occurrence (AO) Report to Congress. In response to the staff's proposal for Appendix C, which was previously provided for your review and comment in SP-98-030, dated April 20,
, 1998, the Commission has provided the following direction.
l Under the new criteria " Appendix C may include, but not necessarily be limited to, events that do not meet the Abnormal Occurrence criteria but have been perceived by Congress or the public to be of high health and safety significance, have received significant media coverage, or have caused the NRC to increase its attention to or oversight of the program area, or a group of similar events that have resulted in licensed materials entering the public domain in an uncontrolled manner."
NRC staff is currently preparing the annual AO Report for Fiscal Year (FY) 1998, and, in addition to previously identified AO events, plans to include any events that meet the new criteria for Appendix C. As indicated in the Office of State Programs procedure SA-300, Reporting Material Events, a monthly management review of both NRC and Agreement State ,
events identified as having a "significant" potential risk to public health and safety is conducted.
NRC staff plans to review any events that were previously included in the agenda for discussion at the monthly management review meetings conducted during FY 1998. NRC staff also plans g to conduct a review of all nuclear material events contained in the Nuclear Material Events l Database (NMED), that were received during FY 1998. Any FY 1998 material events that meet the new criteria for Appendix C will be included in Appendix C. A draft copy of any Agreement )g State events will be provided to the applicable Agreement State.

The Commission has disapproved the staff's recommendatbn to pursue Option 1 and the other 9800019 options presented in the subject paper. Instead, Appendix C should be retained using the l criteria described below to identify events considered for inclusion in Appendix C. When j forwarding draft Abnormal Occurrence reports to the Commission for review and approval, the !
staff should briefly diswss the merits ofincluding each event in the report. The Commission will i exercise its collegial prpcess to determine which events are included in the final Abnormal i Occurrence report. 8700108 i The staff should use the following criteria when considering events for inclusion in Appendix C :
