REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE -

HOLTEC INTERNATIONAL

Dear Mr. Pellet:

By letter dated November 3,1998, Union Electric Company (UE) submitted additional information requested by the NRC staff. The additional information supports an application for license amendment that would allow reracking of the Callaway spent fuel pool. The letter requested that the information be withheld from public disclosure pursuant to 10 CFR 2.790.

An affidavit, dated October 30,1998, executed by you for Holtec intomational, the owner of the information, was included in the application. Holtec Intemational states that the submitted information, " Additional Information Requested fo" the Topics Discussed During the October 14 and 15,1998 Meeting," should be considered exempt from mandatory puolic disclosure for the following reasons:

"(a) Information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention ofits use by Holtec's competitors without license from Holtec Intemational constitutes a competitive economic advantage over other companies.

'(b) Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.

(d) Information which reveals aspects of past, present, or future Holtec intomational l customer-funded development plans and programs of potential comrnercial value to Holtec Intemational. '

(e) Information which discloses patentable subject matter for which it may be desirable to obtain patent protection."

. We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be ,
