WITHHOLDING FROM PUBLIC DISCLOSURE - BASE LINE LEVEL 1 PROBABILISTIC RISK ASSESSMENT FOR SYSTEM 80 NSSS DESIGN By your submittal dated January 22, 1988 and affidavit dated January 22, 1988 you submitted copies of the Base Line Level 1 Probabilistic Risk Assessment for Systen 80 NSSS Design, January 1988, and requested withholding from public disclosure pursuant to 10 CFR 2.790. A non-proprietary version and one other copy of this re-t was submitted by letter dated February 16, 1988.
You stated that ti, submitted information should be considered exempt from mandatory wblic disclosure for the reasons that it contains numerical results of tie System 80 Probabilistic Risk Assessment, which is owned and has been held in confidence by Combustion Engineering, and that public disclosure of the information is likely to cause substantial harm to the competitive position of Combustion Engineering. You stated that the information is of a type customarily held in confidence by Combustion Engineering and not customarily disclosed to the public.
1 We have reviewed your Base Line Level 1 Probabilistic Risk Assessment for System 80 NSSS Design January 1988, based on the requirements and criteria of 10 CFR 2.790 and, on the basis of your statenent, have determined that the submitted information sought to be withheld contains trade secrets or proprietary corrnercial information.
We have determined that the report, Base Line Level 1 Probabilistic Risk Assessment for the Systen 80 NSSS Design, January 1988, marked as proprietary, should be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954 as amended.
We, therefore, approve your request for withholding pursuant of 10 CFR 2.790 and are wit 1 holding the above stated document and information from public inspection as proprietary.

In all review situations, if the NRC needs-additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
