Dear Mr. Dicharry:

On June 24,1997, the U. S. Nuclear Regulatory Commission issued Confirmatory Action Letter

_ (CAL) No. 97-7-006, following an inspection at your facility in St. Rose, Louisiana. Action item No.1 of the CAL suspended fabrication of all NRC-certified transportation packaging until authorization to resume is received from the NRC. This letter describes the basis for us to ,

authorize you to resume fabrication of NRC-certified packagings. This authorization would be i

based on the following:

You submitted on June 24,1997, a test plan to the NRC as required by item No. 2 of the  !

CAL. This completes Action item No. 2 of the CAL. '

. You retested the NRC-certified transportation packages on June 26,1997 and NRC observed your testing activities. You submitted on July 2,1997, the test results to the NRC. The te2t results verified the integrity of the NRC-certified packages. This .

completes Action item No. 3 of the CAL.

You stated in your letter dated July 2,1997, to Dr. Susan Shankman that all packagings, components, specimens, and test records would be pruserved. This completes Action .

Item No. 4 of the CAL. '

The NRC performed an inspection of your Quality Assurance (QA) program implementation for fabrication related aspects on July 9-10,1997. The inspection team identified weaknesses regarding adequacy of procedures, implementation of procedures, and documentation of quality related activities. The findings were not related to the design adequacy of the packagings.

You submitted on July 14,1997, QA Procedure No. 97-01, " Phase I of Corrective Action Irnplementation Plan for SPEC QA Program" (Plan), Revision (0), dated July 13,1997. You stated that the purpose of this Plan is "[t)o assure that all QA fabrication related activities are g<

performed in compliance with the QA Program prior to the resumption of limited fabrication and i distribution activities." The NRC finds the Plan to be acceptable. The NRC requests that you D inform us in writing when you have completed the corrective actions described in QA Procedure No. 97-01 and at that time you may request authority to resume fabrication.

Regarding fabrication, please assure that, pursuant to the requirements of 10 CFR 71.111, '

" instructions, procedures, and drawings," all activities affecting quality are prescribed by documented instructions, procedures, and drawings, that the instructions, procedures, and crawings are followed, and that the results of the activities are documented. Your fabrication tetivities are subject to future NRC inspections.

Action item No. 5 in the CAL remains open. This Action item requires SPEC to obtain the services of an independent QA expert to audit the effectiveness of SPEC's QA program in complying with the requirements of 10 CFR Part 71, advise the NRC regarding the name and qualifications of the expert by July 21,1997, and conduct the independent audit within 60 days of advising the NRC. The NRC requests that you inform us in writing when the independent audit is completed, and include the results of the audit and any follow up actions you plan to take regarding findings identified in the audit. '
