Dear Mr. Jones:
This is in response to your letter dated December 30, 1987, in which you appealed Mr. Donnie H. Grimsley's response dated December 22, 1987.
Mr. Grimsley's response denied the records which relate to an investigation on whether boron testing was properly conducted on nuclear power plants.
Acting on your appeal, I have carefully reviewed the record in this case and have detemined that the previously withheld records will continue to be withheld from public disclosure pursuant to Exemp(tion (7)(A) of the F0IA (5 U.S.C. 552(b)(7)(A)) and 10 CFR 9.17(a)(7) i) of the Commission's regulations.
The requested records are compiled for law enforcement purposes. They relate to a matter which has been referred to the Departirent of Justice (D0J). The matter is still pending with D0J.
This is a final agency decision. As set forth in the FOIA (5 U.S.C.
552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside or have your principal place of business or in the District of Columbia.

552, as amended.
It has come to my attention that the NRC's Office of Investigation conducted an inquiry, beginning on or about 1983, into whether boron testing was being properly conducted on nuclear power plants in which Combustion Engineering and/or its officials was/were the main subject (s) of this investigation or whether unidentified subcontractors may have been of primary focus.
However, I believe centering on claims that boron pellets that the investigation used in cooling rods were not adequately tested prior to installation at active power plants - was a large-scale undertaking, that the subject should be a familar one to the NRC and that the file could be located based on the limited information available for this request.
It is also my understanding that this investigation is officially closed and should be releasable under provisions of the federal FOIA.
Please send me a complete copy of the report, including any and all supporting documents.
